FLOOD CONTROL AND WATER CONSERVATION DISTRICT
Adopted this Order on July 24, 1990 , by the following vote:
AYES: Supervisors Powers, Schroder, McPeak, Torlakson and Fanden
NOES: None
ABSENT: None
ABSTAIN: None
SUBJECT: Hearing on Appeal by Pacheco Properties on Minor
Subdivision 108-89 (Pacheco area) .
RECOMMENDATION:
1 . As Board of Supervisors of the District, APPROVE the
deferral of drainage fees for Parcel D, pursuant to Section
IV of Ordinance No. 88-86, and accept the Grant Deed of
Development Rights executed by the appellant.
2 . As Board of Supervisors of the County, APPROVE the amendment
of Condition No. 6C of the Conditions of Approval of the
above-numbered minor subdivision to read as set forth in
Exhibit A attached to this Order.
3 . As Board of Supervisors of the County, DECLARE that the
appeal has been withdrawn by the appellant.
FINANCIAL IMPACT:
None.
REASONS FOR RECOMMENDATION/BACKGROUND:
On March 19, 1990, the Zoning Administrator approved
Minor Subdivision 108-89 in the Pacheco area. On March 26,
1990, the subdivider (Pacheco Properties; referred to as
"appellant" ) appealed to the Board of Supervisors two advisory
conditions requiring the payment of road fees and drainage fees.
As a result of discussions between the appellant and County
staff, the issues have now been resolved to the mutual
satisfaction of the appellant and the Public Works Department.
Under the resolution reached by the parties, the appellant would
be permitted to defer payment of drainage fees for one parcel
(Parcel D) and Condition No. 6C of the Conditions of Approval
would be modified to clarify the traffic improvements to be
completed by the appellant. With approval of these items, the
appeal would be withdrawn by the appellant.

EXHIBIT A
Condition No. 6C:
Submit a traffic study which includes sight distance requirements
along Pacheco Boulevard from the access road based on the posted
speed limit plus 10 MPH and data on projected traffic generated
by the development. The traffic study dated May 22, 1990
prepared by Edward Franzen, Traffic Engineer, satisfies this
requirement. Perform items nos . 1, 4 and 5 listed as "OWNER
RECOMMENDED PROJECT IMPROVEMENTS" in said traffic study.
