PAYMENTS FROM DEVELOPERS REQUIRED TO MITIGATE STORM
WATER RUNOFF IN THE SAN RAMON WATERSHED, FLOOD CONTROL

Specific Request(s) or Recommendation(s) & Background &
Justification
I. RECOMMENDATION
AUTHORIZE the Chief Engineer to accept in lieu of construction
cash payments from developers required by their conditions of
approval to mitigate the accumulation hydrologic impact from
their development on the San Ramon Creek drainage system.
II. FINANCIAL IMPACT
By combining numerous small projects into one large project
constructed annually, both the District and the developers will
save on project administration costs.
III. REASONS FOR RECOMMENDATION/BACKGROUND
The developers in the San Ramon Watershed are being required to
meet a minimum mitigation standard where their developments
increase the amount of impervious surface. The mitigation
standard is to excavate one cubic yard of material from San Ramon
Creek for each fifty square feet of new impervious surface. On
small developments the mitigation work can be accomplished in one
or two days work.

The District has received letters from the Smith Companies,
Retail Property Development, Co. and Mr. Thomas J. Heafey
requesting they be allowed to make a cash payment for the value
of the work in lieu of performing the work.
It is recommended that the Chief Engineer be authorized to accept
these in lieu payments, to combine them with other future
payments and to annually prepare a single contract to implement
the required mitigation work.
IV. CONSEQUENCES OF NEGATIVE ACTION
The District and developers would continue to incur higher
administrative costs in implementing the required mitigation
work.
