SUBJECT: CONSIDER THE PRIVATE USE OF A PORTION OF THE FORMER
SOUTHERN PACIFIC RIGHT OF WAY - SAN RAMON AREA.

Justification
I. RECOMMENDATION
APPROVE an exception to a Policy Statement adopted by the Board
on February 9, 1988 regarding the private use of the Southern
Pacific Right of Way and AUTHORIZE the Public Works Department to
proceed with the arrangements for the private use of a portion of
the Right of ,Way.
II. REASONS FOR RECOMMENDATION/BACKGROUND
Contra Costa County has been successful in purchasing the
abandoned Southern Pacific Right of Way between the Contra
Costa/Alameda County line and the Concord area allowing this
corridor to be preserved for a variety of public uses. including
future transit. In order to finance this costly acquisition,
easements were sold to Central Contra Costa Sanitary District,
East Bay Municipal Improvement District, and the Flood Control
District. However, to .insure the corridor would remain available
for the intended public uses the Board of Supervisors adopted a
policy statement on February 9, 1988 stating "The Southern
Pacific Right of Way shall remain in public ownership along it's
entire route and not be sold, leased, or broken. "

Sunset Development Company has requested they be allowed to use
an eighteen to twenty-eight foot wide strip within the Right of
Way between Norris Canyon Road and Bollinger Canyon Road in
order to construct the Iron Horse Trail and an adjacent
landscaped area. This strip will not encroach upon a forty foot
wide area set aside for a future undefined transit use. The
completed Trail will be operated and maintained by the East Bay
Regional Park District under an extension of the current license
agreement.
III. FINANCIAL IMPACT
The construction of the Trail and the adjacent landscaping within
the Right of Way will prevent the future construction of utility
lines in that area and may preclude the County's ability to
market valuable continuous strip corridors to utility companies.
The County has, however, made available a space in the Right of
Way for the construction of the Iron Horse Trail at other
locations and at no cost to the builder of the Trail.
