SUBJECT: Request for Waiver of System Capacity Charges from the
East Bay Municipal Utility District for the Wildcat and
San Pablo Creeks Project.

I. RECOMMENDATION
DECLARE that the irrigation system for the Wildcat and San Pablo
Creeks project is temporary, REQUEST a waiver of system capacity
charges from the East Bay Municipal Utility District.
II. FINANCIAL IMPACT
The temporary irrigation system required for the Wildcat and San
Pablo Creeks Project will require six water meters at a cost of
$49, 890. 00. Waiver of the system capacity charges would reduce
the cost of water service to $12 , 090. 00.

III. REASONS FOR RECOMMENDATION/BACKGROUND
The Flood Control District in cooperation with the Corps of
Engineers is implementing the Wildcat and San Pablo Creeks Flood
Control project which requires the installation of mitigation
landscaping. The proposed landscaping consists of native
riparian plant species which are expected to be self sustaining
after an initial three (3) year establishment period. During the
establishment period the plants must be irrigated. For this
purpose, the District has requested the installation of six 1-
1/2 inch water meters from the East Bay Municipal Utility
District (EBMUD) . EBMUD staff has estimated the actual cost of
installing each meter to be $2 , 050. 00. In addition, EBMUD
charges $6, 300.00 per meter, as a system capacity charge, for any
service remaining in place for more than one year.
Although the Corps of Engineers ' requires an elaborate irrigation
system, it is nevertheless planned to be a temporary facility.
On this basis, Flood Control District staff has requested a
waiver from EBMUD eliminating the deposit and payment of the
system capacity charges. EBMUD staff have expressed doubts about
the temporary nature of the irrigation facilities and have
reported that their regulations prohibit our requested waiver
without the approval of their Board.
It is important to the Flood Control District to reduce the cost
of the landscaping project in order to:
1) limit our local cash contribution and
2) to preserve the potential for a positive benefit to cost
value justifying subsequent upstream work. For its part,
the EBMUD will benefit from our project, since the riparian
planting will conserve water when properly established.
Therefore, the Chief Engineer recommends that in addition to
requesting a waiver of the system capacity charge, the Board give
its assurance to the EBMUD Board that:
1) the Wildcat and San Pablo Creeks irrigation system is
intended to be temporary and
2) if for any reason the use of the irrigation system extends
beyond a period of three (3) years after the completion of
planting, the Flood Control District will pay the system
capacity charge.
IV. CONSEQUENCES OF NEGATIVE ACTION
The District 's share of project costs have grown to exceed
available funding, principally due to modifications mitigating
environmental effects. The Districts' financial state will be
further unbalanced if it is required to pay the system capacity
charge.
The EBMUD board may not acknowledge the importance to the
District of a waiver of system capacity charges without the
recommended Board request.
