This resolution requests the legislature to require adequate funding for mandated programs which are enforced by County Agricultural Commissioners/ Sealers. Before the Board of Supervisors in and for the County of Monterey, State of California Legislative Committee Status Report ) on Pending Legislation, Received; ) Staff Recommendations, Approved as ) Amended . . . . . . . . . . . . . . . . ) The Board is in receipt of Legislative Bulletin 89-10 as submitted by the Board' s Legislative Sub-Committee, providing a summary and recommended positions on those bills considered by the Committee at their meeting of July 31, 1989, to be of importance to Monterey County and its operation. After discussion, and upon motion of Supervisor Strasser Kauffman, seconded by Supervisor Del Piero, and unanimously carried by those members present, the Board hereby approves the following staff recommendations, as amended: 1. Adopts the positions taken by County Departments and the Board of Supervisors ' Legislative Committee as outlined in the Legislative Bulletin No. �89-10, as amended by: a. Amend position relative to AB 1813 (Cortese) , from oppose, to suppgrt if amended to include a local option to allow Counties to have a more strict control over fire safety issues. b. Amend position relative to AB 2420 (Mountjoy)., from oppose, to support if amended to include a local option to allow Counties to have a more strict control over fire protection. 2 . Instructs the affected Denartments and the Legislative Coordinator to press for favorable action on the Board's positions. 3 . Send the proposed Resolutions and one page statements to CSAC for consideration and action. (Supervisor Karas absent. ) 1, ERNEST K. By Deputy BEFORE THE GENERAL ASSEMBLY OF THE COUNTY SUPERVISORS ASSOCIATION OF CALIFORNIA Resolution Concerning RESOLUTION P-ROPOSED BY Agricultural Commissioners/ MONTEREY COUNTY Sealers Funding WHEREAS , California is the nation ' s leading state in the production of food and fiber ; and WHEREAS , the California Department of Food and Agriculture is responsible for promoting and protecting agriculture , the environment , and the public welfare ; and WHEREAS , County Agricultural Commissioners/Sealers , located in each county of the state , are the California Department of Food and Agriculture ' s local representatives to carry out programs of protecting agriculture and environment ; and WHEREAS , funding for the specific programs under the authority of County Agricultural Commissioners/Sealers have failed to keep pace with inflationary trends ; and WHEREAS , the current sources of funding for these programs are the County General Fund , monies generated from mill tax sources , legislative action , and fees charged for services ; and WHEREAS , the California Department of Food and Agriculture has been ineffective in their efforts to increase funds for local programs ; NOW, THEREFORE, BE IT RESOLVED by the County Supervisors Association of California that the. Association support legislation that would recognize the services provided by County Agricultural Commissioners/Sealers and support legislation that would provide adequate funding for the continuation of these mandated services ;, BE IT FURTHER RESOLVED that the legislature require the Director of the California Department of Food and Agriculture to develop budget change proposals to adequately fund those programs that are mandated by state law under the authority of the Department of Food and Agriculture . BE IT FURTHER RESOLVED that the Department of Food and Agriculture dispurse these funds to counties based upon individual county workload and verified through the Annual Financial Statement . ADOPTED this day of 1989 by the General Assembly of the County Supervisors Association of California. PRESIDENT STATEMENT OF NEED Resolution Concerning Funding for the County Agricultural Commissioners/ Sealers Programs Prior to the passage of Prop 13 , funding for County Agricultural Commissioners/Sealers came almost entirely from the County General Fund and fees assessed to local agricultural industry for provided services . The California Department of Food and Agriculture does provide a $6 , 600 amount for County Agricultural Commissioners ' salary subvention . In addition to that , legislation passed in about 1970 provided a source of money for agricultural programs from Unclaimed Off-Road Gas Tax . The Mediterranean Fruit Fly infestation in the early 80 ' s , and the passage of legislation subsequent to that , provided another source of funding for Pest Detection . AB 3765 required the development of new pesticide laws and regulations and funding was provided for the enforcement of those provisions . In addition , legislation providing funding from the Nursery , Seed , Apiary, and Egg industries was also passed . A mill tax assessment on the value of pesticides sold rounds out the funding received by counties . Currently , County Agricultural Commissioners/Sealers Offices receive funding which amounts to from 40 to SO percent of their budgets from the above mentioned sources and fees charged to the agricultural industry for services . The balance comes from the County General Fund . Cost of living increases are needed plus additional funds required to continue the operation of increased' responsibilities for these mandated -programs .
