SUBJECT: EARLY RETIREMENT RESOLUTION NO. 89/633
The Board of Supervisors of contra Costa County RESOLVES THAT:
1. By Ordinances 76-63 the Board of Supervisors has adopted the
provisions of Government Code section 31641.04, permitting early
retirement service credit.
II. Because of an impending change in the manner of performing
certain services in the Social service Department, and fn order
to achieve savings in money and other economic benefits for the
County, the best interests of Contra Costa County will be
served by permitting additional service credit for certain
members of the Contra Costa County Employee's Retirement
Association (members) as follows:
a. The provisions of this resolution are applicable to all
members employed in the job classifications of Administrative
Services Assistant III and Social Service Program Analyst in
the Social Service Department on September 27, 1989 (eligible
members) .
b. Every eligible member who retires between September 27, 1989
and October 20, 1989 shall receive two additional years of
service credit for Contra Costa County service.
c. Upon demand by the Retirement Association, the County Auditor
shall transmit to the Retirement .Fund the amount(s)
determined by the Retirement Board to be the actuarial
equivalent(s) of the difference(s) between the allowance(s)
the eligible member(s) receive(s) after getting the
additional service credit hereunder and the allowance(s)
he/they would have received without such credit.
d. On later re-entry into County employment under circumstances
otherwise requiring or permitting membership in the
retirement system, any member who has received additional
service credit hereunder shall forfeit such additional
service credit, and the County's payments hereunder shall be
refunded, unless the re-entry is the result of a temporary
call-back limited to a maximum of 720 hours of service in any
one calendar year.
e. Provided, nevertheless, that the provisions of this
Resolution are not applicable;

1. To any member otherwise eligible if such member '
received any unemployment insurance payment within
six months prior to September 20, 1989.
2. To any member if the member is not eligible to retire
without additional service credit under this Resolution.

§31641.04.
(a) When the board of supervisors. by resolution, determines that be-
cause of an impending curtailment of service or change in the manner of
performing service. savings of money, or other economic benefit resulting
to the county. the best interests of the county would be served, a member
shall be eligible to receive additional service credit if the following condi-
tions exist:
(1)The member is employed in a job classification,county department,
or other county organizational unit included in the resolution adopted by the
board of supervisors.
(2)The member rehires on or between dates specified by the board of
supervisors in its resolution. In no event shall the specified period exceed ,
180 days.
(3)The county transmits to the retirement fund an amount determined
by the board of retirement which is equal to the actuarial equivalent of the
difference between the allowance the member receives after the receipt of t
service credit under this section and the amount he would have received
without such service credit.The transfer to the retirement fiind shall be made 1
in a manner and time period acceptable to the county and the board of
retirement. 1
(b)The amount of service credit shall be that amount as the board of
supervisors determines but shall not be more than two years regardless of
credited service and shall not exceed the number of years intervening be-
tweea the date of the member's retirement and the date the member would
be required to be retired because of age.
(c)A county which elects to make the payment prescribed by subdivision
(a)shall make such payment with respect to all eligible employees who retire
during the-period specified by the board of supervisors.
(d)This section shall not be applicable to any member otherwise eligible
if such member receives any unemployment insurance payments during the
period six months prior to the period specified pursuant to subdivision (a).
This section shall not be applicable to any member if the member is not
eligible to retire without the additional credit available under this section. !
(e)This section shall not be applicable in any county until it is adopted
by ordinance of the board of supervisors. Any county may adopt or readopt
this section from time to time as conditions may warrant.This section shall
not be applicable in any district whose employees are members of the system
pursuant to Section 31557 until it is adopted by ordinance by the governing
body of the district. Any district whose employees are members of the,
system pursuant to Section 31557 may adopt or readopt this section from
time to time as conditions warrant. -
(f)Any member who qualifies under this section upon subsequent reen-
try to county employment shall forfeit the service credit acquired under this
section. unless the reentry is a result of a temporary call back limited to a
maximum of 720 hours of service in any one year.
(g) This section shall not be subject to the provisions of Chapter 10
(commencing with Section 3500) of Division 4 of Title 1.
