MICHAEL WALFORD, PUBLIC WORKS DIRECTOR DATE: SEPTEMBER 19, 1989 SUBJECT: DELEGATION OF AUTHORITY TO THE PUBLIC WORKS DIRECTOR OR DIRECTOR'S DESIGNEE TO EXECUTE LICENSES ON BEHALF OF THE BOARD OF SUPERVISORS FOR USE OF THE FORMER SOUTHERN PACIFIC RIGHT OF WAY SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION I. Recommended Action: The Public Works Director or Director' s designee is hereby AUTHORIZED and EMPOWERED to EXECUTE, MODIFY or CANCEL on behalf of the Board of Supervisors of Contra Costa County, acting in all of its capacities, license agreements,-, in a form approved by County Counsel and the Risk Manager for use of the former Southern Pacific Right of Way owned by the County. II. Financial Impact: Will save time and money as a result of increased efficiency in processing routine use requests. III. Reasons for Recommendations: Delegation of authority to sign routine license agreements allows for reduction in the time and cost of processing said licenses. IV. Background: Occasionally access is requested for minor, short term purposes to use the former Southern Pacific Right of Way. No permanent property rights are transferred to the licensee. It is not intended that authority be delegated to execute pipeline licenses. V. Consequences of Negative Action: Without delegation of authority to sign, time and cost of processing said license agreements would be higher.
