RECOMMENDATION:
Acknowledge receipt of the attached Report#10 from O'Brien-Kreitzbeig&Associates for the month of May 1989
on the status of construction work at the County's detention facilities.
BACKGROUND:
The attached Report#10 outlines the status of work at the West County Justice Center which is on schedule and within
budget with a projected completion date of May 2, 1990,Marsh Creek Detention Facility which was completed and
certified for occupancy April 21,1989 and actually occupied April 23,1989 within budget and on the Main Detention
Facility which is behind schedule due to contract negotiation problems but is forecast to remain within budget. A
new project schedule is being developed for the MDF which will call for vacating M and F modules,one at a time,
and for construction to occur in December and January,when the inmate population is at its lowest. There are still
.problems with the fire flow at Marsh Creek which does not meet minimum requirements. The most cost-effective
solution to this problem is being sought.

openings has been denied.

EXECUTIVE SUMMARY
A. INTRODUCTION:
This report is subdivided into three major sections: 1) Executive Brief and
Summary, 2) Detailed Schedule and Financial Information and 3) Attachments.
It describes the design and construction progress for the West County
Justice Center, Marsh Creek Detention Facility and Martinez Detention
Facility achieved during the period of May 1989 as well as Areas of Concern.
B. GENERAL:
1. West County Justice Center
a. Environmental Lawsuit
The County has selected the consulting firm of Jones and Stokes
Associates, Inc. to prepare the Court mandated revised EIR. The Board
of Supervisors will be asked to approve the consultant's contract on
June 1. A preliminary meeting with the consultant is scheduled for June
13.
2. harsh Creek Detention Facility
a. Masterplan
The plan, presented to the Board of Supervisors on May 23, was approved.

C. SCHEDULE:
1. West County Justice Center
a. Design:
The 507 Contract Documents Phase submission for furniture, equipment
and signage was received on May 12. The Transition Team and Project
Manager are currently reviewing the submittal.
b. Construction:
1) Contract A: Substantially complete.
2) Contract B: Construction contract critical activity , were
construction of the second floor slab at the Administration
Building and second floor exterior concrete block walls at
Housing Buildings No. 6, 7 and 8. Schedule status was as
follows:

A fifteen calendar day extension has been granted for the
plumbing/structural footing conflict and December and March
rain delays. Another eight calendar day extension is being
recommended for outstanding rain delays and for the
*x electrical room equipment clearance claim.
Based on Contractor's CPM schedule update including
adjustments for rain delays and other contract time
extensions.
2. Marsh Creek Detention Facility
a. Construction
♦ Wastewater Treatment Facility
The Contractor completed construction of the interim wastewater
treatment facility on February 17. Pavement patching is the only
outstanding construction item remaining which is scheduled to be
done by June 1, concurrent with the dorms' pavement patching.

The Contractor continues to correct "punch list" and warranty
items.
3. Martinez Detention Facility
a. Design
The start 'of the M- and F-Module remodel project's Contract
Documents phase began the first week of April. The Architect
met with the Sheriff's Department to review the scope of work on
May 9 and 12. As a result of this meeting, the scope was
somewhat expanded.

4. Martinez Detention Facility

E. MAJOR AREAS OF CONCERN:
1. West County Justice Center:
♦ Contract B: Walsh Construction Company
a. Letter of Credit:
Issue: Contractor has proposed an irrevocable letter of credit
(LC) as A substitution for the retention from the monthly
progress payment.
Action: Due to irreconcilable LC language differences, the
Contractor has now decided to establish an escrow account for
security deposits in lieu of retention per a contract option.
This account becomes effective for the May 1989 Progress Payment.
b. Stop Notice Against the Glazier Subcontractors:
Issue: A Stop Notice was filed by the Glaziers, Architectural
Metal and Glass Workers' Trust Funds against the glazier
subcontractor, Gaffney, for Gaffney's failure to pay glazier's
fringe benefits to the Fund.
Action: The CM has instructed the general contractor to enforce
payment immediately. The amount claimed in the stop notice will
be withheld from the May 1989 Month Progress Payment.
C. Toilet Accessories Claim:
Issue: The Contractor submitted a manufacturer which was not
approved. AE rejected the proposed manufacturer until the
Contractor provided substitution data. The Contractor has
indicated a $17,000 - $19,000 claim if the specified brand must
be used.
Action: The AE rejected some of the alternative manufacturer's
items. The CM issued a decision rejecting the alternative
manufacturer's items disapproved by the AE. The contractor's
detailed claim submittal is due in June 1989.

Contract B: Walsh Construction Company
d. Toilet Accessory Changes
Issue: Based on input from the Sheriff's Department's Transition
Team, the AE has issued a number of toilet accessory changes.
Action: A price quotation is pending from the Contractor.
e. Perimeter Security System:
Issue: The Perimeter Security System in the original contract
design inadvertently fails to cover all slope areas around the
tunnel entrances.
Action: The AE provided a design recommending the use of
microwave systems to cover the slope areas. AE estimates the
addition will cost approximately $13,000. A lump sum price
quotation is pending from the Contractor. In the interim, to
avoid delay, CM has directed the Contractor to proceed on a
time-and-material basis in order not to delay the Contractor.
f. Phone Cables to Site by Pacific Bell:
Issue: Pacific Bell informed the County that its new phone
cables to the site will terminate at the northeast corner of the
site. The contract design shows connection at the southeast
corner of the site. The Pacific Bell cables must be extended to
the southeast corner.
Action: Two options are available. The overhead-cable-on-poles
option will cost $22,000 to $25,000 according the Pacific Bell.
The alternate design of underground-conduit-and-cables will cost
$56,000 to $64,900 according to Walsh. The CM has initiated
contract with Pacific Bell to- pursue the overhead option.
g. Kitchen Carts:
Issue: The cart dimension revised design changes have still not
been finalized. Impact of cart delivery is unknown but is
becoming critical since the AE has not responded in over 84 days.
Action: The CM has directed the Architect to expedite this
change.
h. Central Control Room Equipment Panels:
Issue: The Contractor stated the Central Control Room will not
accommodate all the equipment panels per the layout shown in the
contract drawings.

Contract B: Walsh Construction Company(Cont'd)
Action: The AE has provided a design showing the relocation of
the panels to fit into the room. The Contractor's price
quotation of $7,080 for the relocation was found to be reasonable
and accepted by the CM.
i. Roof Curbs:
Issue: The Contractor contends that (1) the contract structural
drawings fail to show all openings required for mechanical
penetrations; and (2) curb framing around HVAC units are not
shown.
Action: The Contractor's contention regarding the openings was
rejected by the CM and AE; the Contractor has stated his
intention to claim. The curb framing was determined to not be
shown on the contract drawings. The CM has directed the
Contractor to provide the framing on a time and material basis in
order not to delay the work.
j. Additional Quick Chill Unit:
Issue: The County has requested the addition of one (1) quick
chill unit.
Action: The Contractor submitted a price quotation of $19,384.
The CM is reviewing the price.
k. Weed Claim:
Issue: The Contractor has claimed the weeds growing on site are
the responsibility of the County.
Action: The CM has rejected the claim.
1. Duress Alarms:
Issue: The County has requested additional duress alarms.
Action: CM has issued a request for pricing.
M. Strike Plates:
Issue: The County has requested strike guard plates be added.
Action: CM has issued a request for pricing.
n. Telephones:
Issue: Concern was expressed to the County that the telephone
system needs to be procured to meet the legal completion date.

Contract B: Walsh Construction Company(Cont'd)
Action: The County's communication department assured the CM
that with 90 days' notice installation would meet the contract
completion date.
o. Sewage Pump Station:
Issue: The County needs to initiate an agreement with the
district.
Action: The County will follow through with this action.
p. Fence Fabric:
Issue: The County questioned if the non-climbable fabric was
according to contract.
Action: It was confirmed that materials and installation is per
spec.
q. Key Switch Claim:
Issue: The contractor claims the key switches are not shown on
the drawings.
Action: CM decision was issued denying claim.
r. Beam Slope Claim:
Issue: The Contractor is requesting a change claiming that there
is a conflict between the roof-ridge line and the top of roof
steel beam elevation at Buildings 1, 2, 3 and 4. The AE states
the beam slope can be determined by the base contract
requirements.
Action: After a meeting between the CM, the AE and the
subcontractor to discuss the claim, the CM rejected the claim.
S. Duct Openings in Slabs:
Issue: Contract drawings show Ib-inch diameter air duct openings
only at one wing of each housing building but not at the other
three wings. The Contractor claims extra cost for providing 104
additional openings at the other wings.
Action: The CM's and the AE's preliminary evaluation and
response suggest that the claim is without merit since the
openings are typical. The Contractor disagrees with the CM's and
AE's rejection and requests compensation.

♦ Modular Dormitories
a. Unavoidable Delays
Issue: The original contract completion date was February 18;
however, rain delays and unforeseen site conditions have affected
the critical path activities from meeting the scheduled
completion date.
Action: The extended contract completion date to March 15, 1989.
Rains since February 13 will further extend this date pending a
detailed schedule review. The dorms were occupied on April 23.
b. Fire Service
Issue: A new 8" fire main and two new fire hydrants were
installed as required by code; however, fire flow does not meet
minimum requirements.
Action: The fire district, water district, design engineer and
CM met on May '2 to review engineering options. A follow up
meeting with Water District will be held before the most cost
effective solution can be identified.
3. Martinez Detention Facility -
Construction Impact on Facility Operations:
Issue: Construction within M- and F-Module will adversely impact
facility operations and the delivery of health services.
Action: The Sheriff's Department has agreed to vacate the
modules, one at a time, to reduce operational impacts and shorten
the construction period in each module. Construction is planned
to occur in December and January, a period when inmate population
is at its annual low.

SCHEDULE ANALYSIS
1. GENERAL:
The detailed schedule report is subdivided by three projects: 1) West
County Justice Center, 2) Marsh Creek Detention Facility and 3) Martinez
Detention Facility. The three projects are further divided into the design
and construction phases. The design portion will include general design
data and a progress narrative. The construction section will be subdivided
by each contract and will provide contract data, a progress narrative, plus
a bar chart.
2. West County Justice Center
a. Design:
The 507 complete furniture, equipment and signage Contract Documents
were submitted on May 12, approximately 10 weeks behind the original
schedule. The schedule slippage should not impact the furnishings,
equipment and signage procurement schedule.
b. Construction:
The West County Justice Center project includes two contracts:
1) The first contract was for the rough grading of the project site
(Contract A), which is substantially complete.
2) The second is for the construction of the detention facility
(Contract B).

2. PROGRESS NARRATIVE
a. Building One (Administration Building): East side, first floor
concrete block walls, second floor metal decking, deck embeds and slab
concrete pour constituted the critical path work in May. On 5/25/89,
east side second floor slab was poured as scheduled. Taking all
contract time extensions into consideration, Building 1 is considered
to be on schedule.
b. Building Two (Medical/Dental/Library/Classroom Building): Very little
progress this period.
c. Building Three (Multi-purpose Building): No progress during this
period except for the installation of the concrete columns.
d. Building Four (Intake Housing/Central Visiting): Structural steel for
the second floor of the north half and roof of the south half were in
progress. This building was ahead of schedule.
e. Building Five (Inmate Housing): Roof structural steel was in
progress. This building was on schedule.
f. Building Six (Inmate Housing): Second floor exterior concrete block
walls were close to completion. This building was on schedule.
g. Building Seven (Inmate Housing): Second floor exterior concrete block
walls were in progress. This building was on schedule.
h. Building Eight (Inmate Housing): No progress during this report
period. Second floor exterior concrete block walls to start in June.
i. Site Utilities: No progress during this period.
j. Site Work: Perimeter Security Fence fabric installation at the north
and east sides were substantially complete.
3. PROGRESS BAR CHART:
A progress bar chart is included to this report (Attachment D). It
compares the actual physical progress of field activities to their

4. AREAS OF CONCERN:
a. Security/Communication Submittals:
Issue: The Contractor's technical submittals for the communication
systems are behind schedule.
Action: The CM directed the Contractor to expedite submittals. The
CM also requested that the security subcontractor attend weekly
meetings to facilitate communications. The submittals are now back on
schedule.
b. Baseline CPM Schedule:
Issue: The baseline CPM schedule was rejected due to questionable
activity durations and logic, crew loading and cost loading.
Action: The Contractor submitted a revised baseline schedule with
cost and manpower loading . The CM reviewed and discussed it with the
Contractor in late January and mid-March. A second revision of the
revised schedule was submitted by the Contractor in April. It was
reviewed by the CM and generally found to be in order, with a few
minor changes required.

1. General:
The detailed financial report is divided into three projects: 1) West
County Justice Center, 2) Marsh Creek Detention Facility and 3) Martinez
Detention Facility. The projects are further divided into the Design and
Construction phases. The Design portion will include a narrative. The
Construction section will be subdivided by each contract and will provide
contract data, where available, narratives and cost -curves.
2. West County Justice Center
a. Design:
The Architect's basic fee is $2,705,923 of which $2,424,163 (90%) has
been paid. In addition, the Architect has been authorized $376,020 for
extra services, of which $255,472 (68%) has been paid.
b. Construction:
The West County Justice Center financial report includes two contracts:
1) The first contract was for the rough grading of the project site
(Contract "A") which is substantially complete.
The remaining contingency for Contract "A" is <$2,150.
2) The second contract is for the construction of the detention
facility (Contract "B").
The remaining contingency for Contract "B" is $959,920.

for the grading phase and has requested a partial release of
retention. The request is being evaluated by the CM.
B. A discrepancy in the contract documents between the date when power
will be required by the Contract A Contractor for the testing of the
pump station equipment and the date when permanent power will be
supplied by the Contract Contractor to the pump station has resulted
in the issuance of a proposed change (PCO) for temporary power supply.

A cost curve is attached, comparing the actual progress (cumulative actual
value of work completed and permanent materials delivered to site) as of the
report date (5/25/89) to the Contractor's forecast progress. The
Contractor's forecasts (early start forecast and late start forecast) are
based on the values assigned to individual activities in the Contractor's
12/23/88 revised baseline schedule. The actual value of base contract work
completed to date is $11,899,675; for change orders, it is $131,438. The
total value to date becomes $12,031,113. The actual amount of payment to
the Contractor is the actual value of work less retention.
4. AREAS OF CONCERN
A. Fire Protection System Design:
Issue: The contract design provides a dry standpipe for sprinkler
system whereas the fire code requires a separate wet standpipe system to
service additional (wet) hose reels. Therefore, the Contractor's shop
drawings were rejected by the Fire Marshal.
Action: The AE proposed using fire extinguishers as a substitution for
the hose reels. AE's proposal was approved by the Fire Marshal. Design
details have been issued to the Contractor. A price quotation is
pending from the Contractor.
B. Kettle:
Issue: The specific manufacturer can not make the 80 gallon gas kettle
as specified.
Action: The AE issued a design change, instructing the Contractor to
provide two 80 gallon electric kettles.
