SUBJECT: Retroactive Payment to Family Ways
SrEC I F I C REQUEST 1 S 1 Oft RECOMMENDATION(S) [k SACKGROUND AND JUSTIFICATION
I . RECOMMENDED ACTION :
Ratify purchase of services from Family Ways in excess of the
payment limit of Contract #26-176 (as amended by Contract
Amendment Agreements 426-176-1 , #26-176-2 , and 426-176-3 ) for
the month of June 1989 , and authorize the County
Auditor-Controller to pay the outstanding balance , not to exceed
$8 ,500 .00 for said services .
II . FINANCIAL IMPACT :
The twelve-month payment limit of Contract #26-176 (effective
July 1 , 1988 through June 30 , 1989 ) , as amended by Contract
Amendment Agreements 426-176-1 , #26-176-2 , and #26-176-3 was
$220 ,000 . Approval of this Board order will increase the
Contract Payment Limit to $228 ,500 . Funding for this additional
payment was considered by the Health Services Department and is
included in the Department ' s proposed Fiscal Year Budget .
III . REASONS FOR RECOMMENDATIONS/BACKGROUND :
In June 1988, the County Administrator approved , and the
Purchasing Agent executed , Contract #26-176 with Family Ways ,
effective July 1 , 1988 through June 30 , 1989 , for provision of
temporary licensed nursing personnel to assist Merrithew
Memorial Hospital and Clinics during peak loads , temporary
absences and emergency situations . Family Ways is a nursing
registry which specializes in nurses trained for labor and
delivery, post-partum, and newborn nursery.
'During the term of the_ Contract , the Board approved three
Contract Amendment Agreements , 426-176-1 , #26-176-25, and
X626-176-3 , each of which increased the payment limit of Contract
#26-176 . The increases were necessary because the Department
experienced a situation in which, not only did the inpatient
census rise to an historical high, but the nationwide shortage
of nurses caused the Department to rely heavily on nursing
registries in order to provide patient care in accordance with
Title XXII . In addition , the unanticipated rise in the number
of babies born . at the Hospital made accurate projection of
expenditures impossible .

During the term of the Contract , nursing registry services were
requested as needed by County staff and provided by the
Contractor in good faith . Because of administrative oversight
by both the County and Family Ways use of the registry services
exceeded the final contract payment limit by $8 ,500 .
The Health Services Department is requesting that the amount due
Family Ways be paid . This can be accomplished by the Board of
Supervisors ratifying the actions of County employees in
obtaining provision of nursing registry services of a value in
excess of the contract payment limit . This will create a valid
obligation on the part of the County, retroactively authorizing
all payments made by the Auditor—Controller up to now, and
authorizing payment of the balance .
