Contract Amendment for Testing Services
Specific Request(s) or Recommendations(s) & Background & Justification
RECOMMENDATION
APPROVE $35,000 for expanded testing services required by the West County
Justice Center project and AUTHORIZE the Director, Justice System Programs
to amend the County' s contract with Smith-Emery Company.
FINANCIAL IMPACT
There is no impact beyond that already planned for and .budgeted. The
$600,000 budgeted for testing, permits and fees has an unencumbered balance
of $57, 000. Testing expenses are eligible for reimbursement from the Board
of Corrections. (Proposition 2 grant) .
REASONS FOR RECOMMENDATION/BACKGROUND
The initial contract with Smith-Emery Company for $87 , 806 was based on a
bid scope of work consisting of unit prices for inspection hours and
certain types of material tests. The inspection hours and quantities of
tests were listed as part of the bidding documents based on a preliminary
County estimate. Although anticipated as limited service, some time was
included for shop fabrication and roof testing. The scope of work for
testing developed before a construction contract was awarded.
The original budget for fabrication shop inspection of $3, 000 was based on
the assumption that steel would be fabricated in the area therefore: only
requiring periodic nearby one day inspections. The low bid steel
subcontractor fabricated this work at an out of state location, thus
requiring additional inspection, travel and per diem. The inspection for
steel cost..-: approximately $34,000, an increase of $31,000 over the budget.
The contract for testing services budgeted $1,120 for periodic roof
inspection; however, in order to maintain the manufacturer' s bonded
warranty, the roof installation will require near full time inspection.
Although only a very limited amount of roofing has been installed, the
inspection effort will probably cost $4,000 - 5 ,000 , an increase of at
least $3 , 000.

The third element of work requiring supplemental funding has been for
overtime. The construction contract calls for full time inspection of
masonry installation. In order to meet his schedule requirements, the
masonry contractor worked most fair weather Saturdays during the time he
was installing building perimeter walls. Although inspection time for
this work was budgeted, the premium overtime portion was not. This
Saturday work has kept the overall project on schedule.
