HomeMy WebLinkAboutMINUTES - 09121989 - 1.54 TO: Board of Supervisors FROM: Phil Batchelor, County Administrator O� arei3IVllk ; DATE: September 5, 1989 '• sr�,cou>z't`t SUBJECT: LEGISLATION: AB 2313 (Roybal-Allard) Specific Request(s) or Recommendations(s) & Background & Justification RECOMMENDATION: Adopt a position of SUPPORT in regard to AB 2313 by Assemblywoman Lucille Roybal-Allard which would allow the court to send a notice of delinquent parking citation to the individual who was actually renting or leasing the car at the time the parking citation was issued when the lessee or rentee is identified by the registered owner of the vehicle. The bill would also prohibit the Department of Motor Vehicles from refusing to renew the registration on a vehicle where the vehicle has unpaid parking citations if the owner provides an abstract or notice of disposition of parking violation.The bill also requires the court to provide the owner of a vehicle with such an abstract or notice of disposition of parking violation. BACKGROUND: Under current law,if an individual receives a parking ticket while renting or leasing a vehicle and does not pay the citation,the owner of the vehicle receives a notice of delinquent parking citation. The owner can complete affidavit of non-liability for the citation by identifying the individual who was renting or leasing the vehicle at the time the citation was issued. The court is then required to either cancel the notice of delinquent parking citation or file a complaint against the rentee or lessee. AB 2313 would also allow the court to serve or mail the identified rentee or lessee a notice of delinquent parking violation. Normally,the Department of Motor Vehicles is prohibited from renewing the registration on a vehicle if there are outstanding delinquent parking citations. Under current law,the owner of the vehicle has to file an affidavit of non- liability which identifies who was actually renting or leasing the vehicle at the time the delinquent parking citation was issued in order to get the vehicle reregistered. The court then provides the registered owner an abstract or notice of disposition of parking violation. The registered owner can then provide this abstract or notice of disposition of parking violation to the Department of Motor Vehicles and obtain the registration on the subject vehicle. The Municipal Court Administrator notes that AB 2313 attempts to address a problem area for the Court and should be supported by the Board of Supervisors, even though there appear to still be some technical problems with the process which is outlined in the bill. At this writing,AB 2313 was in the Third Reading File on the Senate Floor and may well be on the Governor's Desk by the time the Board of Supervisors has an opportunity to act on this recommendation.
