HomeMy WebLinkAboutMINUTES - 09121989 - 1.52 E TO: Board of Supervisors FROM: Phil Batchelor, County Administrator DATE: September 5, 1989 'C; osrA-couzz`�`t SUBJECT: LEGISLATION: AB 1861 (Maxine Waters) Specific Request(s) or Recommendations(s) & Background & Justification RECOMMENDATION: Adopt a position in OPPOSITION to AB 1861 by Assemblywoman Maxine Waters regarding appointments to the Private Industry Council(PIC)and authorize the Chairman to request the Governor to veto the bill if it reaches his Desk. BACKGROUND: Current federal law requires that the Board of Supervisors appoint business representatives to the PIC from nominations made by a general business organization, such as chambers of commerce. AB 1861 imposes a requirement on a Board of Supervisors that one-half of the business appointments to the PIC represent businesses that employ persons in occupations with future high-growth potential for the service delivery area. The Executive Director of the PIC notes the following problems with this requirement: 1. There is no definition provided as to what qualifies as"high-growth potential". 2. If the Chambers of Commerce do not nominate representatives of businesses with"high-growth potential"there is no way for the Board of Supervisors to comply with this requirement. 3. The bill makes a false implicit assumption that businesses with high-growth potential will be those businesses with available jobs for Job Training Partnership Act(DTPA)participants. In fact,it is just as likely that businesses with high-growth potential will hire very few employees in relation to the entire job market and that these jobs may not be suitable for JTPA participants. Businesses with low-growth potential may actually hire more employees to replace retiring workers and because of the expansion of facilities as they are modernized. There is a subtle implication in the bill that representatives of businesses with low-growth potential are less desirable representatives of business than are representatives of businesses with high-growth potential. For the above reasons the PIC recommends that the Board of Supervisors oppose AB 1861. AB 1861 was in the Senate Appropriations Committee at this writing and may be sent to the Governor by the time the Board acts on this recommendation. We have therefore recommended that the Chairman be authorized to ask the Governor to veto AB 1861 if it reaches his Desk.
