Bragdon Contra Director of Community Development DATE: May 1, 1989 Costa Cay^ SUBJECT: Hearing on Rezoning Application #2825-RZ, to rezone 13 . 3 acres from General Agricultural District (A-2) to Single Family Residential District (R-40) , fronting approximately 2,000 feet along the east side of the Southern Pacific Railroad, immediately south of Lone tree Way, in the Brentwood area, filed by Bellecci and Associates (Applicant) and Richard J. Taylor (Owner) . (APN 018-080-014 ) SPECIFIC REQUEST(S) OR RECOMMENDATIONS(S) & BACKGROUND AND JUSTIFICATION RECOMMENDATIONS 1. Accept the environmental documentation prepared for this project as being adequate. 2. Deny Rezoning Application #2825-RZ as recommended by the East County Regional Planning Commission as set forth in Resolution No. 20-1989. BACKGROUND At its ' meeting of March 27, 1989, the East County Regional Planning Commission voted to recommend that the Board of Supervisors deny the subject rezoning. The Commission could not make the finding of General Plan consistency necessary to approve the rezoning request. CONTINUED ON ATTACHMENT: YES SIGNA .!5JX/& RECOMMENDATION OF COUNTY ADMINISTRATOR RECOMMENDAT ON OF COMMITTEE APPROVE OTHER SIGNATURE(S) : ACTION OF BOARD ON August 8, 1989 APPROVED AS RECOMMENDED X OTHER On July 11, 1989, the Board of Supervisors continued to this date the hearing on the recommendation of the East County Regional Planning Commission of the County of Contra Costa on the request by Bellecci and Associates (applicants) and Richard J. Taylor (owner) to rezone 13.3 acres of land from General Agricultural District (A-2) to Single Family Residential District (R-40) ( 2825-RZ) in the Brentwood area. Jean Mesick, Community Development Department, presented the staff report on the request, describing the site, and commented on the Planning Commission recommendation for denial and the reasons for the recommendation. She advised the Board of the staff recommendation that the Board accept the environmental documentation prepared for this project as adequate, that the Board deny the rezoning and also deny the appeal of Subdivision 7231 before the Board also today. She commented on the receipt of a letter from the City of Brentwood requesting that the rezoning request and the subdivision be denied. The public hearing was opened and the following person appeared to speak: Frank Bellecci, Bellecci and Associates, 2252 Stanwell Drive, Concord, representing Richard Taylor, commented on the basis for the application including the surrounding lot sizes and configurations and requested approval of the project. The public hearing was closed. Supervisor Torlakson indicated that this request was premature and would violate the criteria for planning in this area in the General Plan and violate the spirit of Brentwood' s plan, and that for those reasons, the recommendations of the Planning Commission and the staff, he moved to adopt the staff recommendations. On recommendation of Supervisor Torlakson, IT IS BY THE BOARD ORDERED that recommendations 1 and 2 are APPROVED.
