SUBJECT: Hearing on Rezoning Application #2819-RZ, to rezone 1.14 acres from
Single Family Residential (R-40) to Single Family Residential (R-12) ,
located at the northwest corner of Loren Lane and Mellowood Drive, in
the Oakley area, filed by Bellecci and Associates (Applicants) and
Fred D. Lorenzetti (Owner) . (parcel No. 035-230-009)

RECOMMENDATIONS
I. Accept the environmental documentation prepared for this
project as being adequate.
2. Deny the Rezoning Application #2819-RZ as recommended by the
East County Regional Planning Commission.
BACKGROUND
Following a public hearing at the East County Regional Planning
Commission meeting of March 13, 1989, the Commission voted to deny
the proposed rezoning. The majority felt that the allowable lot
size resulting from approval of the rezoning request would be
incompatible with surrounding properties.

On July 11, 1989, the Board of Supervisors continued to this date
the hearing on the recommendation of the East County Regional Planning
Commission on the request ( 2819-RZ) by Bellecci and Associates
(applicant) and Fred Lorenzetti (owner) to rezone 1 .14 acres situated
at the northwest corner of Loren Lane and Mellowood Drive from Single
Family Residential (R-40) to Single Family Residential (R-12) in the
Oakley area.
Karl Wandry, Community Development Department, advised the Board
of an agreement between the applicant and the neighbors relative to
neighbors ' concerns, and that Mr. Bellecci had withdrawn his request
for three of the lots to go commercial, and had agreed to build homes
with a minimum of 2500 square feet on those lots. He commented on the
staff recommendation to approve the rezoning.
Supervisor Torlakson commented on the agreement and requested
whether a condition could be placed on the matter relative to
participation in an assessment district for finishing Loren Lane.

Mr. Wandry advised the rezoning could not be conditioned but that
the applicant could be asked to participate. He commented that the
agreement was between the applicant and the neighbors and that the
County is not a part of the agreement except as to the withdrawal of
the application.
The public hearing was opened and the following persons appeared
to speak:
Frank Bellecci, Bellecci and Associates, 2552 Stanwell Drive,
Concord, representing Fred Lorenzetti, commented on the proposal of an
assessment district.
The public hearing was closed.
Supervisor Torlakson recommended the acceptance of the agreement
that has been reached as recommended by the staff and he requested
that the Community Development Department contact the Public Works
Department to explore with the neighbors the concept of some
assessment district or some means of finishing the street in a timely
manner.
IT IS BY THE BOARD ORDERED that the agreement reached by the
applicant and the neighbors is ACCEPTED; Community Development
Department is REQUESTED to contact the Public Works Department to
explore with the neighbors a means of finishing Loren Lane; and
rezoning application 2819-RZ is APPROVED and Ordinance No. 89-52,
giving effect to the rezoning is INTRODUCED, reading waived, and
August 15, 1989 is set for adoption of same.
