HomeMy WebLinkAboutMINUTES - 08081989 - T.3 T. 3 THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Order on August 8, 1989 by the following vote: AYES: Supervisors Powers, Fanden, Schroder, McPeak and Torlakson NOES: None ABSENT: None ABSTAIN: None -------------------------------------------------------------------=- --------------------------------------------------------------------- SUBJECT: Hearing On Petition By Joseph and Dorothy Pereira To Cancel The Restrictions Of An Agricultural Preserve Contract (File 3-73 ) In The Briones Hills Area. On July 25, 1989, the Board of Supervisors continued to this date the hearing before the Board of Supervisors on a petition by Joseph and Dorothy Pereira to cancel pursuant to Section 51282 of the Government Code the restrictions of an Agricultural Preserve Contract (File #3-73 ) for a 45 acre parcel located at 1130 Christie Road in the Briones Hills area. Robert Drake, Community Development Department, presented the staff report on the request and reviewed the background of the Agricultural Contract. He commented on the recent filing by the applicants of a Notice of Non-Renewal which will cause the contract restrictions on this property to expire in 1997. He advised that the request before the Board would allow an earlier cancellation of the contract restrictions. Mr. Drake commented on the required findings that must be made in order for the cancellation to be approved by the Board. Supervisor Powers inquired whether there was anything inconsistent with the Briones Hills Agreement in granting this request. Karl Wandry, Community Development Department, responded that the cancellation itself would not violate the Briones Hills Agreement and he commented on possible subsequent actions. The public hearing was opened and the following people appeared to speak: Frank Pereira, 6040 Alhambra Valley Road, Martinez, representing Joseph and Dorothy Pereira, spoke in favor of the request to cancel the Agricultural Preserve Contract #3-73 . Howard Higgins, P.O. Box 457, Antioch, representing Citizens Land Alliance of Contra Costa County, spoke in favor of the request. The public hearing was closed. Supervisor Fanden requested direction from other Board members. Supervisor Schroder advised that if the Board has grounds to cancel the Williamson Act Contract then it would be reasonable. Supervisor Powers commented on violating the spirit of the Briones Hills Agreement. Supervisor Torlakson expressed support for denial of the request. Supervisor Schroder suggested deferring the decision on the matter and consulting with staff on the guidelines to be followed in the cancellation of the Williamson Act. • The Board discussed the matter. Supervisor Powers moved to continue the matter for one week. Supervisor Torlakson requested clarification from County Counsel on the legal issues related to this request. IT IS BY THE BOARD ORDERED that the decision on the petition by Joseph and Dorothy Pereira to cancel restrictions of Agricultural Preserve Contract *3-73 is DEFERRED to the August 15, 1989 Determination Calendar.
