August 8, 1989 COJ* SUBJECT: CONSENT TO SUBSTITUTION OF SUBCONTRACTORS FOR FIRE STATION NO. 7, 1050 WALNUT AVENUE, WALNUT CREEK (AUTHORIZATION NO. WH882B) SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACWA:ZOUND AND JUSTIFICATION I. RECOMMENDATION: CONSENT to the substitution of intended subcontractors for painting and fire protection for construction of Fire Station No. 7, 1050 Walnut Avenue, Walnut Creek, Budget Line Item No. 7100-4882, Authorization No. 0928-WH882B, pursuant to Public Contract Code Section 4107. 5 II. FINANCIAL IMPACT: None. III. REASONS FOR RECOMMENDATION/BACKGROUND: A. On July 13 , 1989, bids were opened for the subject project. On July 14, 1989, the low bidder, Pacific Construction Corps, notified the County that an inadvertent clerical error was made in the listing of subcontractors for painting and fire protection and requested approval to substitute the intended subcontractors for these two trades. B. The listed painting subcontractor was E. Turman & Co. of Pleasanton and the intended painting subcontractor was Tolner Painting of Menlo Park. The listed fire protection subcontractor was Cosco Fire Protection of Hayward and the intended fire protection subcontractor was Marquee Fire Protection of Sacramento. C. Both of the subcontractors listed in error and both of the intended subcontractors have been notified of the error. in accordance with Public Contract Code Section 4107. 5 and all have agreed that an inadvertent clerical error was made and have submitted letters consenting to the substitutions. IV. CONSEQUENCES OF NEGATIVE ACTION: Failure to approve this recommendation will leave the matter unresolved and will delay awarding of the contract for construction and will thus delay comp etion of the project. Concord, CA The above-captioned project and the specifications therefor being approved,, Addenda No. 1, No. 2 and No. 3 being issued and bids being duly invited and received by the Director of• General Services; and The County Affirmative Action Officer having determined that the bidder listed first above meets the requirements of the County Minority and Women Business Enterprise Contract Compliance Program; and The Director of General Services recommending that the bid listed first above is the lowest responsive and responsible bid, and this Board concurring and so finding; Page 1 of 2 IT IS BY THE BOARD ORDERED that the contract for the furnishing of labor and materials for said work is awarded to said first listed bidder at the listed amount and at the prices submitted in said bid; and that said contract shall present two good and sufficient surety bonds as indicated above; and that the General Services Department shall prepare the contract therefor; and IT IS FURTHER ORDERED that after the contractor has signed the contract and returned it, together with bonds as noted above and any required certificates of insurance or other required documents, and the Director of General Services has reviewed and found them to be sufficient, the Director of General Services is authorized to sign the contract for this board; and IT IS FURTHER ORDERED that in accordance with the project specifications and/or upon signature of the contract by the Director of General Services, any bid bonds posted by the bidders are to be exonerated and any checks or cash submitted for security shall be returned; and IT IS FURTHER ORDERED that the Director of General Services is authorized to sign any escrow agreements prepared for this project to permit the substitution of securities for moneys withheld by the County to ensure performance under the contract, pursuant to Section 4590 of the Government Code; and IT IS FURTHER ORDERED that the Director of General Services is authorized to consent to the substitution of another person as a subcontractor, in any of the situations listed and after the written notice specified in Public Contract Code Section 4107, provided written objections to such substitution are not submitted by the listed subcontractor in accordance with Section 4107.
