Cisterman Director of Personnel January 23, 1989 Ron Yank, Attorney at Law Carroll , Burdick & McDonough One Ecker Building Ecker & Stevenson Streets San Francisco CA 94105 Dear Mr. Yank: This side letter enunciates agreements reached regarding terms and conditions of employment for Sheriff's Aides and Sheriff's Specialists during meet and confer negotiations between County representatives and the Deputy Sheriff's Association. A. ECONOMICS 1 . Shift Differential In the hours which qualify for shift differential , employees in the classification of Sheriff's Aide or Sheriff's Specialist shall receive effective January 1 , 1989 five percent (5%) above their base salary rate. To qualify for shift differential , an employee must have a regularly assigned daily work schedule which requires: a . Completion of more than one and one-half (1-1/2) hours over the normal actual working time; or b. At least four (4) hours of actual working time from 5:00 p.m. through 9:00 a.m. inclusive. However, employees who have been regularly working a shift qualifying for shift differential immediately preceding the commen- cement of a' vacation, paid sick leave period, paid disability or other paid leave, will have shift differential included in com- puting the pay for their leave. The paid leave of an employee who is on a rotating shift schedule shall include the shift differen- tial that would have been received had the employee worked the - shift for which the .employee was scheduled during such period. . ipme1 INTERNATIONAL PERSONNEL MANAGEMENT ASSOCIATION MEMBER 1 `Ron Yank, Attorney at Law January 23, 1989 Page 2 . Shift differential shall only be paid during paid sick leave and paid disability as provided above, for the first thirty (30) calen- dar days of each absence. 2. Health Plan/Dental Plan Provisions of Section 17.1 through Section 17.8 in the 1987-89 Memorandum of Understanding between Contra Costa County and the Deputy Sheriffs' Association are applicable to newly-hired employees in the classifications of Sheriff's Aide and Sheriff's Specialist, with health plan -and/or dental coverage becoming effective the first of the calen- dar month following hire. 3. Hazard Pay Effective January 1 , 1989 employees in the classification of Sheriff's Aide who work in the following designated areas shall receive a five percent (5%) base pay salary differential for each hour worked in a hazardous area or assignment: a. "D" Module in MDF b. Booking desk in MDF c. Process Server working out of the Court Services Division 4. Overtime and Compensatory Time Provisions of Section 7.1 and 7.2 in the 1987-89 Memorandum of Understanding between Contra Costa County and the Deputy Sheriffs' Association are applicable effective January 1 , 1989 to employees in the classification of Sheriff' s Aide and Sheriff' s Specialist. 5. Uniform Allowance Effective January 1 , 1989, a uniform allowance of twenty-five dollars ($25 .00) per month will be paid through June 30, 1989. Effective July 1 , 1989, the monthly uniform allowance shall be ter- minated and in lieu thereof, employees eligible for uniform allowance shall receive a yearly lump sum payment on December 10, 1989 and each December 10th thereafter of three hundred dollars ($300.00) . Said yearly payment, which is for the period July 1 through June 30, shall be prorated for employees hired after July 1 . Employees who terminate employment after January 1 and prior to July 1 shall be required to pay back excess uniform allowance by an automatic deduction from his/her final pay check. , Ron Yank, Attorney at Lbw - January 23, 1989 Page 3 B. MISCELLANEOUS 1 . Training Training for Aides and Specialists which is both reasonable and necessary should be arranged. Training required by C.A.C. standards, department policy or the nature of assignment will be provided uti- lizing the same criteria as applied for sworn personnel . Resources and Planning will continue to send pertinent information regarding training classes to each divisional representative who will see to it. that the Aides/Specialists in their division receive copies. 2. Shift Assignments a . Sheriff's Aides in the Detention Divison will be allowed to sign up on a separate list for shifts, by seniority, at the same time and for the same perios a� sig,-:upsSfor sworf� pe�sonne.l . ..�sr��� csxC wz rdv.Ai(\ U" Qe :A :�f ��r \�: -t- 90,e \Ctn Shift trades between Aides and/or Specialists shall be governed by the same criteria as allowed for sworn personnel shift trades. 3. Overtime a . Overtime will be offered first to those Aides trained and working in the vacant position. However, if there is an extra Deputy Sheriff not on overtime available to fill the vacancy, no Aide will be called in. b. An attempt will be made to allow Aides (within the same Division) to fill in a scheduled absence of another Aide for vacations/schools. 4. Cross-Training Cross-training shall be mandatory for all duties within any Detention sub-unit. Cross-training will be confined to individual bureaus within the Division. As new line positions are created and their responsibilities diversify within the Division, existing personnel will receive basic training in the new functions. The amount of cross-training to be offered for the new positions will be determined by the need for flexibility between the established and new functions. If the new position is a single specialized staff position, there will be no need to cross-train. Ron Yank, Attorney at Law January 23, 1989 Page 4 5. New Positions/Transfer Opportunities a . Sheriff's Aides are encouraged to apply for any Specialist examina- tions administered through the County merit system but are not eli- gible for direct transfer into Specialist positions. , b . All Sheriff's Aide or Specialist transfers will be governed by the attachment, "Sheriff's Aide/Specialist Transfer Policy and Procedures" , listed as . "Attachment All . - Except as noted . above, the -provisions of the 1987-1989 Memorandum of Understanding shall apply to Sheriff's Aides and Sheriff' s Specialists. If the foregoing conforms to your understanding, please indicate your approval and acceptance in the space provided below. WPH:yb ER1 :11 Attachment 7.1 ATTACE +LENT "A" ' SHERIFF' S AIDE/SPECIALIST TRANSFER POLICY AND PROCEDURES i 1 . When a Sheriff' s Aide or Specialist vacancy occurs in any Division, the Personnel Officer will announce the vacancy. Included in the announcement will be a brie` job description, the current job classification, and a contact person in the Division where the vacancy exists . Interested individuals will submit to the Personnel Officer notification of their interest, in writing, within the prescribed period. 2 . Only Sheriff ' s Aides with one year in their present position may qualify for Aide openings; only Sheriff ' s Specialists with one year in their present position may qualify for Specialist openings. Sheriff ' s Aides are encouraged to apply for any. Specialist examinations administered thr-ough the county merit system but are not Gam; , eligible _.for drect transfer into specialist positions. 3 . A Selection Committee will be convened after the cut-off date to review the applications. This Committee will be comprised of a) the Division Commander (or designee) where the vacancy exists; b) the Personnel Officer; and c) a representative of the Deputy Sheriffs' Association (non-voting) . 4. The Selection Committee will consider the following areas when reviewing those employees who have applied. a. Job Performance b. Sick Leave record C. Seniority d. Possession of special skills or training 5. The Committee will develop an informal recommendation list for the Sheriff to review. The_Sheriff will make the selection .from the list. Employees will be promptly notified of the Sheriff ' s selection. 6 . Certification of names from the Personnel Department may be requested if: a. No interest is shown by Department employees, or b. If the Selection Committee, with the concurrence of the Sheriff, determines that none of the applicants j are qualified. 3
