SUBJECT: LEGISLATION: SB 780 (Petris & Roberti)
Specific Request(s) or Recommendations(s) & Background & Justification
RECOMMENDATION:
Adopt a position of SUPPORT for SB 780 by Senators Petris and Roberti which would require the State Department
of Health Services to issue grants to counties to develop pilot projects to reduce the generation of hazardous wastes
by small generators.
BACKGROUND:
The legal disposal of hazardous waste which is generated by small quantity generators is an issue of substantial
concern to the Board of Supervisors and to the Hazardous Materials Commission. It is extremely expensive for small
quantity generators to properly dispose of hazardous wastes which they generate.
Senators Petris and Roberti have introduced SB 780,which as amended July 18, 1989,would do all of the following:
1. Adopt Legislative findings regarding the need to provide assistance to small quantity generators to properly
dispose of hazardous wastes, to assist small quantity generators reduce the amount of hazardous waste which
is generated at the source and where this is not feasible to encourage recycling.
2. Direct the State Department of Health Services to establish and administer a small business assistance pilot
project by issuing a grant to a county to develop a pilot project which will incorporate the hazardous management
priorities specified in state law and which will reduce the generation of hazardous waste by small quantity
generators and which will design and develop an expanded route.collection system to legally dispose of
hazardous waste generated by small quantity generators and which will prevent the illegal disposal of hazardous
waste in solid waste landfills.

3. Allow any county to apply for the grant. The Department would be required to give preference in awarding the
grant to a county which indicates commitment to continue the project after state funding has expired and which
has entered into a memorandum of understanding with the Department to enforce state hazardous waste laws.
4. The maximum amount of the grant could not exceed $140,000.
These funds would come from the existing Hazardous Waste Control Account.The county would also have to show
that it would receive an amount equal to 30%of the grant from other public or private sources,including the federal
government. The county would be able to use up to 40%of the grant to subsidize the cost of collection of hazardous
waste. A county which wishes to apply for the grant would have to submit a final application by May 1, 1990. The
Department would be required to select a grant recipient by October 1, 1990. The grant recipient would be required
to submit a report to the Department by October 1, 1992 describing the implementation of the small business
assistance pilot project and the extent to which the program was successful in addressing the problem of the illegal
disposal of hazardous waste.
SB 780 has passed the Senate and was scheduled to be heard in the Assembly Ways&Means Committee on August
23, 1989.
On August 23, 1989 the Hazardous Materials Commission voted unanimously to urge the Board of Supervisors to
support SB 780.
