SUBJECT: STATUS REPORT ON PLANS TO PROPERLY DISPOSE OF USED OIL
Specific Request(s) or Recommendations(s) & Background & Justification
RECOMMENDATIONS:
1. Request the Joint Committee on Household Hazardous Wastes to draft language and return it to
our Committee on October 23, 1989 at 9:00 A.M., which would impose on all new landfills and
transfer stations as a condition of approval a requirement that they make provision for accepting
used oil from the public or garbage collection companies.
2. Request the Community Development Director to contact the major oil companies which do
business in Contra Costa County, used oil recycling companies and other organizations and
companies involved in the business of recycling used oil and ask them to meet with the Internal
Operations Committee on October 23, 1989 at 9:00 A.M.to discuss ways in which they can assist
the Board of Supervisors in used oil recycling programs, in transporting used oil from drop-off
centers to companies which recycle used oil, in providing technical assistance to the Board of
Supervisors, cities and franchisees and in assisting in the development and implementation of
a used oil public education program.
3. Request the Community Development Director to consider the need for additional legislation
which will make the proper and safe disposal of used oil easier,particularly in the area of liability
exposure and propose any changes which are needed to our Committee on October 23, 1989 at
9:00 A.M.
4. Request the Joint Committee on Household Hazardous Wastes to report to our Committee on
October 23, 1989 at 9:00 A.M. on the model set of guidelines/regulations for the disposal of used
oil on which they are presently working.

5. Leave on referral to our Committee the referrals relating to used oil.
BACKGROUND:
On November 1, 1988 and January 17, 1989 a number of referrals were made to our Committee by
the Board of Supervisors dealing with used oil. On May 2, 1989 some of these referrals were also
made to the Joint Committee on Household Hazardous Wastes which is composed of representatives
from the Solid Waste Commission and the Hazardous Materials Commission.
On July 24, 1989 representatives of the Joint Committee (Councilwoman June Bulman and
Councilwoman Rosemary Corbin)met with our Committee and presented the attached report which
is incorporated herein by reference. It is the Joint Committee's plan to have in place by March 1,
1990 curbside and dropoff recycling programs for used oil, latex paint and car batteries, the three
products which make up a significant portion of household hazardous waste and whose handling
and disposal are not regulated as rigidly as are pesticides, which are the other large component of
household hazardous waste.
In order to make such a recycling program work, we believe that we must have the cooperation of
the oil companies which form such a significant component of the industrial base of this County,
as well as those retail outlets which are already handling used oil and the companies which currently
recycle used oil. We also want to insure that any new landfill and all future transfer stations provide
facilities for the receipt and handling of used oil. In addition, we want to continue to work with the
Joint Committee and staff to complete work on all of the referrals which are before our Committee.
We believe that the Joint Committee has made a great deal of progress and we would like to express
our appreciation to them and the Community Development Department staff who have worked with
the Joint Committee. We will make a further status report to the Board following our October 23,
1989 meeting.

SUBJECT: Committee Activity to Date on Used Oil Recycling
BACKGROUND:
On March 27, 1989 the Community Development Department was
forwarded a number of referrals pertaining to used oil from the
Internal Operations Committee. On May 1, 1989, referrals 1,2,4,
5,6 were sent to the Joint Committee on Household Hazardous Waste
(HHW) for review and reporting. Referrals 3,7,8 will be addressed
by the Community Development Department. This memo will provide
a brief discussion on the activities of the committee regarding
used oil issues to date. Rosemary Corbin and I will be glad to
discuss this report in more detail at the Internal Operations
Committee on July 24, 1989.
ACTIVITIES OF THE JOINT COMMITTEE ON HHW:
Referral 1: The Joint Committee has made plans to implement public
used oil recycling opportunities into the household hazardous
waste portion of the Household Waste Management Plan (HWMP) .
That plan was adopted by the Hazardous Materials Commission
on June 7, 1989 and is currently being sent to the cities for
approval before being sent to the State Department of Health
Services for final review and approval. In that plan, garbage
franchisors and franchisees are directed to work together to
establish accessible and affordable used oil recycling for
Contra Costa residents.
Referral 2: While the HWMP does not specifically require that
interim or permanent transfer stations are locations for used
oil recycling programs, it does require that either curbside
recycling or drop off centers are operated by every
franchisee.
Referral 3: Attached is an analysis of the current laws and
regulations affecting the storage and disposal of used oil,
and an assessment of the danger that improper disposal
presents to public and environmental health. This paper was
developed for a recent workshop on household hazardous waste
sponsored by the Association for Bay Area Government and the
Oceanic Society. The committee that developed this report
acknowledges the support of the Contra Costa Community
Development staff in providing background materials for the
report content. Page 9 of this report outlines regional
recommendations for the establishment of public, used oil
programs.
Referral 4: A model set of guidelines/regulations for the disposal
of used motor oil is on the agenda for the Joint Committee.
Proposed guidelines include:
o Garbage franchisees must establish program to accept used
oil. They can do this by working with their franchisors,
providing either a drop off point or a curbside pick up.
o To develop screening mechanisms to guard against
contaminated wastes from being brought to the recycling
program.
o To assure that the programs are operating at a regular
basis (at least one time per month) for all communities .
o To develop liability controls for accepting wastes from
the public.
o To integrate the collection program into a long-term
public education campaign.
When these guidelines are finalized they will be presented to
the Board of Supervisors and to the franchisors.
Referral 5: The County's Household Hazardous Waste Program will
integrate a used motor oil component into their public
education campaigns . The public education campaign is
predicated on the belief that the waste minimization hierarchy
should be implemented at every point possible. Therefore, the
recycling of used motor oil must be a priority in Contra Costa
County.

OTHER HHW ACTIVITIES:
Used oil recycling programs are being developed in conjunction with
latex paint and car battery recycling programs, and are considered
Phase 1 of a Household Hazardous Waste Collection Program for
Contra Costa County. Phase 2 of this program will be the
establishment of permanent collection and disposal facilities for
more complex and nonrecyclable household hazardous wastes. The
Joint Subcommittee will be developing a working paper on the
recycling options available for Phase 1 of the collection and
disposal program. This paper will be finalized in August of 1989
and presented to franchisees (and possibly franchisors) in
September, 1989. The current goal is to have used oil, paint, and
car battery recycling programs on-line by March 1, 1990. The
subcommittee will keep the Board of Supervisors fully informed of
our activities .

BACKGROUND
The Community Development Department has prepared reports and
recommendations to the Internal operations committee on the
recycling of used motor oil. The Hoard has referred several
items to the Community Development Department regarding used
motor oil recycling. The are:
1. Preparation of an analysis of current laws and regulations
affecting storage and disposal of used oil with a view to
formulating a program ,to accurately assess the dangers of
used oil storage;
2. Development of a model set of regulations for the disposal
of used oil;
3. Request staff to meet with the Hazardous Materials
Commission and determine ways in which the proper disposal
of used motor oil can be made an integral part of the the
County's Household Hazardous waste Program.
since January. the first of a series of joint meetings of the
committee on Household Hazardous waste has been bald. The
committee consists of members of both the solid waste and
Hazardous Materials Commissions. The Committee is studying the
recycling of used motor oil as part of the Household Hazardous
Waste Program. It is appropriate for the joint Committee to be
referred these issues for report back to the Board.

Board agenda for May 2, 1989 (1-59) is intended only to ask the joint Hazardous Materials
Comtnission/Solid Waste Commission Committee on household hazardous wastes to consider
certain items which are currently on referral either to the Department or the Internal Operations
Committee. Specifically,these aro items 1,2,4,5,&6 of my memo to you dated March 27,1989,a
copy ofwhich isattached.Item 3from thatmemohas been completed and item?&8 will bereported
back to the Internal Operations Committee directly by staff on July 24, 1989 at 9:30 A.M.
Do you anticipate that the joint Committee will be in a position to report to the Internal Operations
Committee on any of the five items which are on referral to them on July 24 as well? If not,when
would you anticipate that such a report could be scheduled?
While the language in the Board orders asking for reports on some of these items may not be crystal
clear,I'd like to assume that all 7 items(excluding item 3 which has been completed)are on referral
to the Internal Operations Committee so rhes all reports go back through the Committee before going

In a memorandum dated Mirch 27, 1989 you asked the status of eight items
pertaining to used oil on referral to the Internal operations Committee. This
memorandum is to give you a status report on these eight items.
We have prepared the attached Board Order, which will be scheduledfor the May
2, 1989 Board meeting, that will address five of the eight items. our
recommendation is to, refer those issues to the new Joint Committee on Household
Hazardous Waste, made up of members of the Hazardous Materials Commission and
the Solid Waste Coamission. The new Joint Committee is in the midst of
discussing these issues. Our Department is cooperating with the County Health
Services Department in assisting the Joint Committee.
Item A3 of the March 27, 1989 memorandum requests our Department to prepare
letters to franchising agencies concerning curbside recycling of motor oil.
Attached is a copy of the letter that was ,sent to the franchising agencies.
This completes this item.
For the last two items (A7 and 8), we will be prepared to report at the July 24,
1989 Internal Operations Canmittee meeting.

She Board of Supervisors has reviewed options for safe and convenient disposal
of used motor oil by County residents. The State's Health and Safety Code
specifically eo:ampts this material from regulation as a hazardous waste if it is
included in curbside collection programs. We recommend the inclusion of used
motor oil as a component of all curbside collection of recyclabie materials.
We are aware of model curbside collection programs that include used motor oil
which are successfully serving the residents of Los Altos, Palo Alto, Sunnyvale
and Mountain view.
A report on used motor oil by the Community Development Department is available
for your review. Please telephone Sheila Cogan, Resource Recovery Specialist,
at 646-4196 for a copy.
