RECOMMENDATION:
Adopt a position of SUPPORT in regard to AB 2460 by Assemblyman Hannigan
which prohibits a public agency from approving a development project unless
a method exists to finance the necessary roads, schools, water and sewer
facilities .
BACKGROUND:
The Superintendent of the Liberty Union High School District has asked
Supervisor Torlakson to obtain the support of the Board of Supervisors for
AB 2460 . Supervisor Torlakson has indicated to the Superintendent that he
supports AB 2460 and has directed that it be placed on the agenda for the
Board' s consideration.
AB 2460 prohibits a public agency from approving a development project
unless a demonstrable method exists for financing the necessary roads,
schools, water and sewer facilities, and other public facilities directly
related to the development project . The bill would apply to any
development project for which a public agency accepts an application as
complete on or after January 1, 1990 .
AB 2460 would require that a method of financing infrastructure be
identified for those facilities which are directly related to the
development project before the project could be approved. This will
probably mean that some development projects will be slowed down until such
financing can be identified. However, the bill will result in an increased
level of assurance that financing will be available for necessary
infrastructure before a development project is approved. This may lead to
some increased dispute regarding what the precise impacts of a given
development project are and what is acceptable evidence of available

Specific Request(s) or Recommendations(s) & Background & Justification
RECOMMENDATION:
Authorize the Chair of the Board of Supervisors to send a letter to SenatorAlan Cranston asking for
his support of S 833 and S 905 to restore the right of local regulatory agencies to regulate cable
television rates and for other purposes.
BACKGROUND:
Senator Metzenbaum introduced S 833 to re-establish the right of cities and counties to regulate basic
cable rates in areas with an absence of real competition.
Senator Lieberman:introduced S 905 to restore the rights of cities and counties to regulate cable rates,
to review ownership patterns at renewal or transfer,and to re-establish must-carry requirements. The
National League of Cities supports both bills. Staff concurs that these bills are essential in the
absence of real competition to allow for the regulation of cable rates by responsible government
agencies.
Since deregulation in 1982,our local cable companies have raised their rates between 44%and 86%.
Complaints about rates are second only to customer service complaints.
S 833 and S 905 would enable local government to once again provide citizens with protection
against unreasonable and frequent cable rate increases in areas that lack effective competition.
