HomeMy WebLinkAboutMINUTES - 08011989 - 1.35 TO•'` '" Board of Supervisors Jj� 1-035 FROM: Phil Batchelor, County Administrator Ol DATE: July 24, 1989 ' ST4 Lvul— SUBJECT: LEGISLATION: AB 1457 (Katz) Specific Request(s) or Recommendations(s) & Background & Justification RECOMMENDATION: Adopt a position of SUPPORT for AB 1457 by Assemblyman Katz which would require towing companies to accept credit cards, allow the furnishing of electronically produced facsimile copies of parking citations and authorize parking enforcement officers to specifically enforce vehicle registration laws. BACKGROUND: Existing law does not require towing companies to accept credit cards for the cost of towing and storage of vehicles. AB 1457 would require these companies to accept valid bank credit cards for the payment of towing and storage charges. Existing law requires a police department which has issued a citation for a parking violation to provide the person who received the citation a photostatic copy of the original citation on request. AB 1457 would also allow the police department to meet this requirement by providing an electronically produced facsimile copy of the citation. Existing law does not specifically authorize parking enforcement officers to enforce vehicle registration laws. AB 1457 would provide such specific authority. Absent: Abstain: AUG 17989 cc: County Administrator Attested Municipal Court Administrator Phil Batchelor, Clerk of the Board Director,Justice.Systems Programs of Supervisors and County Administrator Assemblyman Richard Katz n Les Spahnn,SRJ.Jackson, Banish&Associates L✓ % ��Z�/Z� By , Deputy Clerk CLVM:eh(ab1457bo) Each of these provisions either is a benefit to the consumer in that they can pay a towing and storage bill with a credit card when they may not have the cash readily available, or is a liberalization of current law to reflect technological advances such as we now have with the Walnut Creek Police Department where the parking citation is produced by computer and there is not an"original"citation to copy, or clarifies existing law in a way which is beneficial to law enforcement agencies and the Courts by specifically authorizing traffic enforcement officers to enforce vehicle registration laws, meaning they can cite the owner for having an expired vehicle registration tag on the car, which should help to generate additional revenue for the County. The Municipal Court Administrator recommends that the Board of Supervisors support AB 1457 and this office concurs with that recommendation. AB 1457 passed the Assembly June 22, 1989 by a vote of 68:3 and is currently on referral to the Senate Transportation Committee.
