SUBJECT: LEGISLATION: SB 1160 (Robbins &Presley)

RECOMMENDATION
Adopt a position of SUPPORT for SB 1160 by Senators Robbins and Presley which would prohibit DMV from
registering or renewing registration on a vehicle unless the owner has furnished proof of financial responsibility,
provides penalties for providing false evidence of financial responsibility, repeals the sunset of the law which
requires a driver to have proof of financial responsibility available in a vehicle if he stopped for any other reason
by a police officer,repeals the sunset provision on related provisions of law relating to the requirement that a driver
carry proof of financial responsibility in a vehicle at all times, and requires DMV to report to the Legislature by
January 1, 1992 on the results of the financial responsibility program.
SB 1160 makes significant progress in tightening up the financial responsibility statutes by involving theDepartment
of Motor Vehicles in enforcing its provisions by requiring that they verify proof of insurance before a vehicle is
registered or reregistered. In addition,it continues existing provisions of law which require that proof of financial
responsibility be carried in a vehicle at all times. The Municipal Court Administrator recommends that the Board
of Supervisors support S B 1160, which we understand will be further amended to strengthen further the financial
responsibility program. This office concurs in the recommendation that the Board support SB 1160 and indicate
that support to Senators Robbins and Presley.
SB 1160 passed the Senate June 30, 1989 by a vote of 28:4 and is now on referral to the Assembly Finance and
Insurance Committee.
