Development in the Martinez Area ( 2838-RZ; 3012-89 ; SUB 7304

RECOMMENDATION
Refer the appeal in this matter to the Planning Commission, which
has a scheduled hearing of September 12, 1989 to consider the
project proposal.
BACKGROUND
This is an appeal of an administrative decision not to require
the preparation of an Environmental Impact Report for rezoning
to planned unit development to divide 24 acres into 12 lots. The
appeal should be considered with the Planning Commission' s review
and recommendation to the Board concerning the proposal, further
described as follows:
GDL CONSTRUCTION AND DEVELOPMENT- (Applicant) - Angelina
Compaglia (Owner) : The project consist of three related
applications:
County File #2838-RZ: A request to rezone 1.12+ acres from
General Agriculture District (A-7) and Single Family
Residential District (R-7) to Planned Unit District (P-1) .
County File #3012-89 : A request for Final Development Plan
approval for 12 residential units on 2. 12+ acres.
SUBDIVISION 7304: A request for Tentative Map approval to
divide 2. 12+ acres into 12 lots.
The location for the above referenced project is as follows:
On the west side of Morello Avenue between Village Oaks
Drive and Palisade Drive, in the Martinez area. (A-2) (CT
3200. 02) (ZA:G12) (Parcel. #161-172-0051 006 , 007 )

This being the time heretofore set by the Clerk of the Board of
Supervisors for hearing on the administrative appeal by Michael and
Stephanie Zichichi from the administrative decision relative to
preparation of an Environmental Impact Report for rezoning application
2838-RZ, Development Plan DP 3012-89 and Sub 7304 in the Martinez
area.

Karl Wandry, Community Development Department, advised the Board
that the Contra Costa County Planning Commission has the project and
rezoning before it now for public hearing purposes and commented that
since the rezoning will be before the Board later that the matter be
referred to the Planning Commission to be dealt with with their
recommendation to the Board on the project itself. '
The hearing was opened and the following persons appeared to
speak:
Joseph T. Zichichi, 22 Meleean Lane, Martinez, requested
clarification on the process for hearing this matter.
Mr. Wandry responded to Mr. Zichichi's concern.
Mr. Zichichi expressed no objection to having the matter referred
to the Planning Commission for their recommendation and to having it
hearing before the Planning Commission at their September 12, 1989
meeting with the rest of the project.
Stephanie Zichichi, 22 Meleean Lane, Martinez, expressed
concurrence with Mr. Zichichi 's comments.
Allan Moore, Thiessen, Gagen and McCoy, 279 Front Street,
Danville, representing the applicant, Greg DiLoretto, commented on
letters that were prepared for this appeal today, and he also
requested that' any further requests for continuance by the appellant
be required to be supported by some type of affidavit showing the
necessity to continue these matters.
Mr. Zichichi spoke in rebuttal.
The public hearing was closed.
On recommendation of Supervisor Fanden, IT IS BY THE BOARD
ORDERED that the appeal in this matter is REFERRED to the Planning
Commission for hearing on September 12, 1989 with the project
proposal.
