THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA

AYES: Supervisors Schroder, McPeak, and Torlakson
NOES: Supervisor Fanden
ABSENT: Supervisor Powers

SUBJECT: Appeal of Michael Burk from Sheriff ' s Denial of Cardroom
Work Permit
On August 8, 1989, the Board of Supervisors continued to this
date the hearing on the appeal of Michael Burk from the decision of
Sheriff Rainey relative to a card room work permit.
Supervisor Powers moved to deny the appeal of Michael Burk and
Supervisor Fanden seconded the motion. The vote on the motion to deny
the appeal was as follows:
AYES: Supervisors Powers and Fanden
NOES: Supervisors Schroder, McPeak and Torlakson
ABSENT: None
ABSTAIN: None
The motion to deny the appeal failed to pass.
The Board having heard and reviewed the appeal of Michael Burk
from the Sheriff ' s denial of Mr. Burk' s application for a cardroom
work permit, including the arguments of counsel for Mr. Burk and the
Counsel for the Sheriff, the testimony of witnesses, and documentary
evidence; and on motion of Supervisor Schroder, seconded by Supervisor
McPeak, the Board makes the following Order, pursuant to County
Ordinance Code, SS 52-3 .707(d) and 14-4.008:
Michael Burk' s appeal is granted, subject to the following terms
and conditions: Mr. Burk is issued a termporary cardroom work permit,
effective upon his payment of the fee required under County Ordinance
Code S 52-3.707 (c) , and upon the County Probation Department' s
establishment of a drug testing program for Mr. Burk, which program
will be in effect during the entire life of the work permit, and which
program will be paid for entirely by Mr. Burk. The temporary cardroom
work permit issued to Mr. Burk expires on October 3, 1989, at which
time the Board will consider whether to issue Mr. Burk a further
cardroom work permit. On October 3 , 1989, the County counsel will
report to the Board concerning the Contra Costa County Superior
Court' s ruling on Mr. Burk' s petition for a certificate of
rehabilitation (set for hearing on September 26, 1989) .
