THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA
Adopted this Order on November 8, 1983 , by the following vote:

SUBJECT: Hearing on Rezoning Application 2568-RZ and Development
Plan 3035-83 Filed by Jerry Loving, San Ramon Area,
(Michael Conklin, Inc. , Owner)
This being the time fixed for hearing on the recommen-
dation of the San Ramon Valley Area Planning Commission with respect
to the application filed by Jerry Loving (applicant) and Michael
Conklin, Inc. , (owner) , (2568-RZ) to rezone land in the San Ramon
area from General Agriculture District (A-2) to Limited Office
District (0-1) , together with Development Plan (#3035-83) ; and
Harvey Bragdon, Assistant Director of Planning, having
described the property site and having advised that a Negative
Declaration of Environmental Significance was filed for the
proposal; and
The Chairman having opened the public hearing and, no one
having appeared in opposition, the public hearing having been closed;
and
The Board having considered the matter, IT IS BY THE BOARD
ORDERED that rezoning application 2568-RZ is APPROVED as recommended
by the San Ramon Valley Area Planning Commission and that the
Development Plan (#3035-83) is APPROVED subject to conditions
imposed by the Planning Commission as set forth in Exhibit A
attached hereto and by reference made a part hereof, and the Board
hereby adopts the Planning Commission' s reasons, set forth in its
Resolution No. 36-1983 (SR) , as its determinations for this decision.
IT IS FURTHER ORDERED that Ordinance Number 83-61 giving
effect to the aforesaid rezoning is INTRODUCED reading waived and
November 29, 1983, is set for adoption of same.

CONDITIONS OF APPROVAL FOR DEVELOPMENT PLAN 3035-83:
.1. Development shall be generally as shown on the revised site plan dated received on
September 6, 19839 by the Planning Department, the revised preliminary grading plan
and the revised elevations both dated received September 9, 1983. Development shall
be subject to final review and approval by the County Zoning Administrator prior to
the issuance of a building permit. The gross square footage of the subject office
building shall not exceed 17,820 sq. ft. If the external deck/walkway areas on the
second floor are required for building access, than one-half of the floor area of these
decks/walkways shall be attributed to the buildings gross floor area.
2. Prior to issuance of a building permit, elevations and architectural design of buildings
and structures shall be subject to final review and approval by the County Zoning
Administrator. The roofs and exterior walls of the buildings shall be free of such
objects as air conditioning equipment, television aerials, etc., or screened from view.
Exterior lights shall be deflected so that lights shine onto applicant's property and not
toward adjacent properties. Modifications to the project design.may be made based
on energy conservation considerations. The applicant shall submit samples of
exterior materials to be used together with proposed color schemes. Calculations of
floor areas shall accompany the request for building permits.
3. Signs shall conform to the requirements as established in the Sign Control Combining
District. All signs shall be subject to review and approval by the County Zoning
Administrator. A sign program shall be submitted, including directory signs if
proposed, to establish sign design, dimensions, lighting and locations. One free-
standing sign at the project entrance is permitted. This sign shall be setback a
minimum of ten (10) feet, have an area of not more than 25 square feet and a
maximum height of not more than six feet above finished grade. Signs shall be of a
material and design to complement the proposed design of the office building.
4. Off-street parking shall be provided according to code requirements except that a
variance is granted to have 30% compact car spaces and to provide 81 on-site spaces
at 220 gross square feet yield per space provided. Compact spaces and handicap
spaces shall be appropriately identified. A further variance is granted to have wheel
stops at landscape areas allowing vehicles to overhang landscaping 214 feet for regular
spaces, 2 feet for compact spaces. Backout dimension for compact cars be a
minimum of 24 feet. All spaces shall be double striped.
5. Sewage disposal serving the properties concerned in this Development Plan shall be
provided by the Central Contra Costa Sanitary District. The sewers located within
the boundaries of the properties concerned in this Development Plan should become
an integral part of the Central Contra Costa Sanitary District's sewerage collection
system.
6. Water supply serving the properties concerned shall be by the East Bay Municipal
Utility District. Such water distribution system located within the boundaries of the
properties concerned in this Development Plan should become an integral part of the
.East Bay Municipal Utility District's overall water distribution system.

7. Comply with the landscape and irrigation requirements as follows:
A. Prior to Issuance of a building permit, a landscape and irrigation plan shall be
submitted for review and approval by the County Zoning Administrator. A cost
estimate or copy of contract for landscaping Improvements shall be submitted
with the plan. Landscaping and irrigation shall be installed prior to occupancy.
B. The proposed trees on the site are to be a minimum of 15 gallons in size. The
proposed shrubs on the site are to be a minimum of 5 gallons In size.
C. Landscaping material shall include .drought resistant native and/or adapted
native trees such as oak, bay, sycamore and/or buckeye trees.
D. All initial landscaping shall be a size so that a mature appearance will be
attained within three years of planting.
E. Deciduous tree planting shall be incorporated into the landscaping plan where
possible to provide shade in the summer while allowing winter sun to penetrate.
F. Special care shall be taken to choose low plant material where landscaping is
overhung by automobiles.
G. Large shrubs shall be utilized along the Bollinger Canyon Road frontage to
screen the parked cars from view.
H. Plant materials are subject to further review and approval of the Zoning
Administrator.
I. Plant materials proposed within the Bollinger Canyon Road right of way shall be
subject to review and approval by the Contra Costa County Public Works
Department.
3. Tree planting within the proposed landscape buffer area shall reflect a minimum
planting ratio of one tree to 300 square feet . Irrigation of this area shall be
provided.
S. Parking lot light standards shall be subject to review and approval of the Zoning
Administrator. It is the Intent of this approval that the parking lot light standards be
as low in height as functionally permissable with a proposed maximum height of 12
feet.
9. A pedestrian connection shall be provided from the northwest corner of the proposed
structure, through the parking area and up into the proposed landscape buffer area.
10. If archaeologic materials are uncovered during grading, trenching or other on-site
excavation, earthwork within 30 meters of these materials shall be stopped until a
professional archaeologist who is certified by the Society of California Archaeology
(SCA) and/or the Society of Professional Archaeology (SOPA) has had an opportunity
to evaluate the significance of the find and suggest appropriate mitigation measures,
If they are deemed necessary.

11. Comply with the requirements of the Building Inspection Department as follows:
A. A grading permit will be required for the earthwork necessary to develop the
subject development.
B. Four (4) copies of plans showing the existing contours, the extent of the proposed
grading, drainage Improvements and general site development shall be submitted
with the application for grading permits.
C. Prior to the Issuance of building and/or grading permits in the development, a
preliminary soil investigation report, prepared by a licensed soil engineer will be
required. It shall report on the ability of the site to support the improvements
anticipated, and shall include recommended foundations designs to achieve
maximum stability of the proposed structures.
D. Building foundations shall be designed to counteract swelling and uplift charac-
teristics of the expansive soil at this site.
12. Comply with the requirements of the Central Contra Costa Sanitary District for
sewers and easements.
13. A soils report shall be presented to the Planning Department for review and approval
prior to building permit issuance.
14. Any substantial change to the approved plan will necessitate filing of a new
application. Any substantial change to the grading pian or "day-light" line along the
northern portion of the site shall necessitate the filing of a new application.
15. All sales, demonstrations, displays, services and other activities shall be conducted
entirely within an enclosed building. Outside storage is expressly prohibited.
16. The design and location of garbage bin areas and transformer pads shall be subject to
review and approval by the County Zoning Administrator.
17. Establishment of an eight foot setback and ten foot rearyard constitute variances
from the yard requirements of the O-1 District. Development of a structure with a
height exceeding 35 feet constitutues a height variance from the 0-1 District.
Development of a structure exceeding 15,00 square feet In size constitutes a further
variance from the 0-1 District. These zoning variants are approved as requested;
they meet the requirements of Secion 16-2.006 of the County Ordinance Code.
18. No development shall occur on this site until the general plan amendment for this site
(1983 2-A) is adopted by the County Board of Supervisors as one of the three
permitted amendments to the Land Use Element of the County General Plan and the
rezoning for this site becomes effective.
19. Development right over the northern 0.92 acres of this property shall be granted to
the County at the time construction on the site begins.
20. Comply with the requirements of the Public Works Department, as follows:

A. Unless exceptions are specifically granted, comply with the requirements
of Division 1006 (Road Dedication and Setbacks) of the County Ordinance
Code= This includes the following:
1.= Construct curb, 8-foot 6-inch sidewalk (width measured from curb
face), necessary longitudinal and transverse drainage, and pavement
widening on Bollinger Canyon Road. The face of curb shall be
located 20 feet from the centerline of the street. The sidewalk
shall not be required northerly of the entrance driveway.
2. Install street lights on Bollinger Canyon Road. The final number
and location of the lights will be determined by the Traffic
Engineer.
3. Relinquish abutter's rights of access along Bollinger Canyon
Road with the exception of one access point to be approved by
the Public Works Department.
B. In accordance with Section 82-2.014 of the County Ordinance Code,
this development shall conform to the requirements of Division 914
(Drainage) of the Subdivision Ordinance.
C. Prevent storm drainage, originating on the property and conveyed in
a concentrated manner, from draining across the sidewalk or on driveways.
D. Furnish proof to the Public Works Department, Land Development Division,
of the acquisition of all necessary rights of entry, permits and/or .
easements for the construction of off-site, temporary or permanent,,
road and drainage improvements.
E. Install all new utility distribution services underground.
F. Submit improvement plans prepared by a registered civil engineer to
the Public Works Department, Land Development Division, for review;
pay the inspection, plan review and applicable lighting fees. These
plans shall include any necessary traffic signing and striping plans
or review by the County Traffic Engineer. The improvement plans shall
be submitted to the Public Works Department, Land Development Division,
prior to the issuance of any building permit. The review of improvement
plans and payment of all fees shall be completed prior to the clearance
of any building for final inspection by the Public Works Department.
If final inspection is requested prior to construction of improve- .
ments, the applicant shall execute a road improvement agreement with
Contra Costa County and post the bonds required by the agreement to
guarantee completion of the work.
G. Obtain an encroachment permit from the Public Works Department, Land
Development Division, for construction of driveways or other improvements
within the right of way of Bollinger Canyon Road.

H. In_-lieu pf constructing offsite road improvements to mitigate the
impacts of increased traffic from this development, applicant shall
contribute to the County Road Deficiency Trust Fund for improvements
to the Crow Canyon Road/I-680 interchange an amount to be agreed upon
by the Public Works Department and the applicant, but not to exceed
$30,000. If agreement cannot be reached, the application shall be
returned to the planning agency for determination of this condition.
The following statements are not conditions of approval, however the applicant should be
aware of these comments prior to attempting to secure building permits.
A. The County Health Department has submitted the following advisory comments:
L Please be advised that the Department of Health Services-Public Health's
approval of plans is required for any proposed food establishment, pool or spa
pool prior to construction or Installation. The applicant should contact this
department if he has any questions. Proceeding without obtaining the Depart-
ment of Health Services-Public Health's approval can result in a financial
penalty.
2. Any deviations or changes affecting the concept of the Development Plan on file
with the Department of Health Services-Public Health and dated 3uly S. 19839
shall be resubmitted for review to determine If such deviations or changes for
the Development Plan can be considered acceptable to the Health Officer.
B. This development shall be required to conform to the ordinance requirements of the
San Ramon Valley Fire Protection District.
C. Annexation of Central Contra Costa Sanitary District and East Bay Municipal Utility
District is required.
