SUBJECT: REORGANIZATION OF FAMILY AND CHILDREN'S TRUST(FACT)COMMITTEE
Specific Request(s) or Recommendations(s) & Background & Justification
RECOMMENDATIONS:
1. Restructure the FACT Committee to consist of 17 members as follows:
One representative from each of the following,to be nominated by the respective organization,reviewed by the
Internal Operations Committee and appointed by the Board of Supervisors:
* United Way of the Bay Area (Contra Costa County).
* Human Services Advisory Commission.
* Criminal Justice Subvention Committee (AB 90).
* Children's Coalition.
* Juvenile Justice/Delinquency Prevention Commission.
* Children and Adolescent Task Force
* Mental Health Advisory Board
* Family and Children's Services Advisory Committee.
* Regional Prevention Network.
* Maternal, Child and Adolescent Health Advisory Board.
* Child Abuse Systems Review Committee.
Six at-large members with expertise in child care, out-of-home placement of children, homelessness, alcohol/
substance abuse treatment,family systems or family preservation,education and/or multi-ethnic services. FACT
should recruit broadly for these at-large members, utilizing these seats to attempt to balance the Committee in
order to reflect the geographic,ethnic,racial and economic diversity of the County. FACT should,once the non-
at-large seats have been filled by the Board of Supervisors,interview all applicants for the at-large seats and make
recommendations for their appointment to the Internal Operations Committee,forwarding all applications that
have been received to our Committee along with FACT's rationale for nominating the individuals they have rec-
oUtmended for a ointment to the 1 rge seats.

2. Authorize FACT to do the following:
A. Under the direction of the Social Services Director,conduct at least a bi-annual needs assessment on family
and children's services in Contra Costa County.
B. Summarize the needs assessment and recommend the establishment of program priorities to the Social
Services Director and the Board of Supervisors.
C. Coordinate with the Social Services Director monitoring of contracts which are funded by AB 1733,AB2994
or the Ann Adler Trust Fund and/or which are the responsibility of the Social Services Department to ensure
programmatic (services) compliance and effectiveness.
D. Ensure that contract monitoring is not conducted by any member of FACT who has a conflict of interest in
that the member,or the member's spouse or business partneris aboard memberor an employee of the contract
agency he or she is monitoring.
3. Authorize FACT to establish an RFP Subcommittee which shall be responsible,under the direction of the Social
Services Director, for preparing,reviewing,rating and recommending to the Social Services Director and the
Board of Supervisors the award of family and children's services contracts, including the appropriate level of
funding for such contracts, with private non-profit agencies and/or public agencies pursuant to:
* the AB 1733 and AB 2994 programs for child abuse and neglect prevention and intervention, and
* the Ann Adler Trust Fund, for leveraging funds with other community resources to maximize public
benefit in family and children's programs.
4. Members of the RFP Subcommittee of FACT shall comply with Contra Costa County's and the State Department
of Social Services' Conflict of Interest guidelines so that the RFP Subcommittee does not include anyone who:
A. Is a board member or an employee of an agency receiving funds from AB 1733,AB 2994 or the Ann Adler
Trust Fund.
B. Is a board memberor an employee of an agency applying for funds from AB 1733,AB 2994 or the Ann Adler
Trust Fund.
C. Has been a board member or an employee of an agency during a 12 month period measured either from the
date he or she resigned from an agency which received funds from AB 1733,AB 2994 or the Ann Adler Trust
Fund at anytime during the preceding fiscal year or after the end of the fiscal year in which that agency
received any funds from AB 1733, AB 2994 or the Ann Adler Trust Fund.
D. Is the spouse or business partner of anyone who is a board member or an employee of an agency which is
currently receiving funds from AB 1733, AB 2994 or the Ann Adler Trust Fund.
5. Designate the County Social Services Department as the responsible County department for administering AB
1733, AB 2994 and the Ann Adler Trust Fund as well as for providing staff support to FACT.
6. Remove this item as a referral to our Committee.
7. The Board of Supervisors order of March 14, 1989 regarding FACT is hereby repealed.
BACKGROUND:
In March 1985 the Board of Supervisors established the Family & Children's Trust (FACT) Committee to
consolidate the responsibilities previously handled by the Child Abuse and Neglect Prevention and Intervention
Committee, the Children's Trust Fund Committee and the Family &Children's Trust Fund Committee. FACT's
composition,responsibilities and conflict of interest guidelines are presently contained in several different Board
Orders.

On May 9, 1989 the Board of Supervisors received and referred to our Committee a letter from FACT requesting
a meeting with the Board of Supervisors to discuss their conflict of interest guidelines. There has been some
controversy regarding some members of FACT who appeared to have a conflict of interest because of their
employment status with one or more of the agencies which was applying for or receiving funds from AB 1733,AB
2994 or the Ann Adler Trust Fund. Those apparent conflicts of interest have now been resolved through the
resignations of several members of FACT.
FACT and the Social Service Department have worked out a proposal which is reflected in the above recommen-
dations which will allow FACT to continue to operate as an advisory board to the department and the Board of
Supervisors and have a Subcommittee which would handle the recommendations for awards of funds from these
three sources. The members of the Subcommittee would not be allowed to have any actual or perceived conflict
of interest. This should satisfy both the legal requirements of the State Department of Social Services and the Board
of Supervisors' conflict of interest guidelines.
