SUBJECT: Foskett General Plan Amendment
SPECIFIC REQUEST(S) OR RECOMMENDATIONS(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATIONS
1 . Authorize a General Plan review as requested by Walt Foskett
for approximately twelve acres located on the south side of
Livorna Road in the Alamo area.
2 . The granting authorization of this request does not imply any
support for this application, but only that this item is
appropriate for study.
3 . By authorizing this review, staff will proceed by preparing an
EIR. When the DEIR is prepared, staff will prepare a report
which will be scheduled for public hearing before the San
Ramon Valley Regional Planning Commission. Following this,
the Commission will forward its recommendations to the Board
for public hearing and final determination.
FISCAL IMPACT
The applicant shall pay an amendment fee to cover the County' s cost
of this study as well as the surcharge.
BACKGROUND/REASONS FOR RECOMMENDATIONS
A similar request was previously considered by the Board of
Supervisors on January 5, January 12 , February 12 and March 1,
1988. The Board of Supervisors on March 1, 1988 denied the Foskett
study request but at the same time requested a status report from
the Community Development Department after July 1988, following
completion of the General Plan update. The original proposal as
requested by Mr. Foskett, Mr. Raymond Suppe and Ms. Dori Anderson

was for a plan amendment for their properties south of Livorna
Road. To make a better planning boundary, staff included land,
bringing the area up to 16 acres in size.
In mid-1988 the status report on this issue included discussion of
numerous other parallel plan amendment requests in the surrounding
area which Mr. Foskett had encouraged. Staff recommended for study
of a 57 acre area. The Board approved the study, but delayed
implementation until staff time was available from the countywide
general plan program to undertake this work.
Early in 1989 work began on this study and a Negative Declaration
was considered. Citizen concerns on the project caused a need for
the preparation of a Draft EIR. The scoping process was completed
and we requested Mr. Foskett to come up with the funding for this
EIR on the 57 acre change.
The other plan amendment requesters didn' t wish to participate in
funding the Draft EIR, so Mr. Foskett requested the project files
to be closed and that his amendment fee be refunded. This has
occurred.
Mr. Foskett has now requested a plan amendment for the smaller 12
acre area, and to proceed on the DEIR for this small project.
Going back to a smaller amendment area is a reasonable request;
staff feels that this study should be authorized.
