SUBJECT: TEI4PORARY LITIGANT AND SPECTATOR SEATING AREA AT A.F. BRAY COURTS
BUILDING; AUTHORIZATION NO. WPE637
SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
I. RECONKENDATION
FIND that an emergency exists and AUTHORIZE the Director of
General Services to proceed in the most expeditious manner,
pursuant to Section 20134 of the Public Contract Code, to
construct a temporary seating area for approximately 100
people on the third floor of the A.F. Bray Courts Building,
1020 Ward Street, Martinez, as required to permit litigants >
and spectators to view the Sun Valley mall plane crash trial-

rial via remote video, and DECLARE that the project, as an
emergency, is not subject to the provisions of the California
Environmental Quality Act.
II. FINANCIAL IMPACT:
The County will submit bills for all costs associated with
this project to the State Administrative Office of the Courts
for reimbursement pursuant to Civil Code of Procedure Section
404. 8.
III. BACKGROUND:
A. The State Judicial Council has coordinated all causes of
action involving the Sun Valley Mall plane crash and has
assigned Contra Costa County to try the case. The trial
is scheduled to start on November 1, 1988 on the second
floor of the new A.F. Bray Courts Building in Martinez.
B. There are over 100 parties to the case, from different
court jurisdictions. The litigants have a right to view
the trial proceedings. The County, however, does not
have a courtroom large enough to accommodate such a
large number of litigants and spectators. Consequently,
the Superior Court Administrator has requested that part
of the unfinished space on the third floor of the A.F.
Bray Courts Building be improved for temporary use by
approximately 100 litigants and spectators, who will view
the trial by remote video.

C. The unfinished space on the third floor was designed to
be completed for two courtrooms in the future when
needed, when funds are available, and when parking is
available to satisfy the demand created by the additional
courtrooms. The improvements for the temporary use,
where practical, will be permanent and will be usable
when the additional courtrooms are completed in the
future.
D. The improvements must be completed by November 1, 1988 so
that the space is available when the trial starts. If
the improvements are not available by that date, the
County will not be able to obtain reimbursement from the
State Administrative Office of the Courts.
E. The normal design, bid, construction process for this
work is estimated to require four to six months. It is
possible °to bypass the normal procedures for bidding the
project and accomplish the project by the November 1,
1988 deadline through the provisions of Section 20134 of
the Public Contract Code when the appropriate findings of
an emergency are made by the Board.
F. Since one of the bases of emergency defined in Section
20134 is . . . "when repair or replacements are necessary to
permit the continued conduct of County operations or
services" . . . ; since the County must provide for the
litigants in the case by November 1, 1988; and since this
cannot be done through the normal procurement process,
it is appropriate to find that an emergency exists so
that the County can continue to conduct its service to
the Court.
