SPECIFIC REQUEST(S) OR RECOMMENDATIONS(S) & BACKGROUND AND JUSTIFICATION RECOMMENDATIONS 1. Accept the environmental documentation as adequate. 2. Make the required findings as contained in the San Ramon Valley Regional Planning Commission resolution. 3. Deny the appeal of the Green Valley Blind Homeowner's Association. 4. Sustain the San Ramon Valley Regional Planning Commission' s approval of File #2007-88 subject to the conditions attached. BACKGROUND/REASONS FOR RECOMMENDATIONS This application for a private ballet school within an existing residence was initially heard and denied by the Zoning . Administrator. The applicant appealed that decision to the 'San Ramon Valley Regional Planning Commission. After taking testimony, the Commission reversed the decision of the Zoning Administrator and approved the proposed school for a two-year trial period. The approval would require the applicant to re-file for another land use permit should they wish to continue the operation beyond the permit period. The Green Valley Blind Homeowner' s Association filed an peal on the Commission' s decision. Supervisor Schroder moved the recommended denial of the appeal and moved to grant the Land Use Permit 2007-88 with amended conditions as presented today. On recommendation of Supervisor Schroder, IT IS BY THE BOARD ORDERED that recommendations 1, 2, 3, and 4 with amended conditions (Exhibit A Attached) are APPROVED. THE BOARD OF SUPERVISORS COUNTY ADMINISTRATOR BY '' , DEPUTY COMA TIONS OF APPROVAL FOR LUP 2007-88 PER 9/27/88 BOARD OF SUPERVISORS APPROVAL 1. This land use permit application is approved for a private ballet school as generally shown on the site plans accompanying the application. The school operation shall be limited to the recreation room above the garage. Other areas of the structure shall be used for residential purposes only. 2. Six and twelve months after commencement of the operation, Community De- velopment Department staff will conduct site investigations to evaluate compliance with this permit. The Department findings will be forwarded to the Board of Supervisors with a copy to the Green Valley Road Blind Home- owners Association. 3. This permit is granted for a period of two years. An extension of the permit period will require a new land use permit application. 4. This permit is granted to Rebecca Crowell as operator and is not transfer- able. 5. The school shall be conducted in a manner such that no music or other noises associated with the school is audible on neighboring properties. Windows to the recreation room shall remain closed during school hours. No students are to be left unattended or out of visual contact at any time, for any reason. 6. No more than two persons, in addition to the owner, shall be employed on the site at any time. 7. Any and all special events (school-related receptions, recitals, etc. ) shall be held off-site. 8. No exterior signage whatsoever shall be permitted except for one sign. 9. No more than ten students shall be present at a time. Hours of operation shall be limited as follows: Period Days of the Week Hours of Operation September 1 thru May 31 Monday thru Friday 3:30 - 6:30 p.m. Saturdays 10:00 a.m. - 1:00 p.m. June 1 thru August 31 Monday thru Saturday 10:00 a.m. - 1:00 p.m. 10. Prior to commencement of the school operation, a landscape irrigation plan of a scope to fully shield the designated parking area from the neighbor's view shall be submitted for the review and approval of the Zoning Adminis- trator. Landscape materials shall consist of a minimum 15 gallon size. Installation of said landscaping shall occur within six months of the com- mencement of the school operation. The applicant shall notify the zoning Administrator for verification of compliance with this condition. -2- r r 11. A building permit is required. Full compliance with State and County laws shall be met prior to commencement of the operation. 12. The project shall comply with State and County laws pertaining to handi- capped students. 13. Prior to commencement of the school operation, the following conditions shall be satisfied: a. approval of landscape plans, by the Zoning Administrator. b. submittal of evidence that the structure is in compliance with the building code for the proposed use. C. submittal of copies of any licenses or permits required by State of California agencies. THE PROJECT IS ALSO SUBJECT TO THE REQUIREMENTS OF OTHER AGENCIES LISTED BELOW. THIS STATEMENT IS INTENDED TO ADVISE THE APPLICANT OF THE REQUIREMENTS OF OTHER AGENCIES WHICH ARE NOT ENFORCEABLE BY THIS PERMIT. San Ramon Valley Fire Protection District.
