Refer the Health Services Director's memorandum of November 79 1983 on this subject to the County Administrator with instructions for the County Administrator to review the recommended actions with the Personnel Department, County Counsel , and other appropriate departments, and return his findings and recommendations to the Board at his earliest opportunity. 2. Remove this item as a Committee referral . BACKGROUND: On October 18, 1983, the Board referred to our Committee recommendations from the Health Services Director relating to efforts which should be undertaken to encourage individuals to stop smoking. These recommendations were submitted by a memorandum from the Health Services Director dated November 7, 1983 which provided additional recommenda- tions. In reviewing these recommendations, it is clear that some will require additional legal research to determine the Board's ability to implement them and, in many instances, discuss with employee organizations. Our Committee is generally in favor of moving in the directions suggested by the Health Services Director. Once the legal research and discussions with employee organizations have occurred, the Board can determine which of the suggested actions should be undertaken. These would be in addition to the previously submitted recommendation that an ordinance be developed requiring no smoking areas in public places such as banks, public buildings, restaurants, etc. The additional Board actions which are most attractive to us are: 1. The Board imposes a licensing fee on businesses that sell cigarettes. The fee can be either a flat fee or based on the volume of sales. Revenue collected can be placed in a special fund for education on smoking and health. 2. The county adopts an ordinance protecting non-smokers from involuntary smoking in the workplace. 3. The county restricts tobacco advertising by banning it on billboards, public transportation, and any other area under county jurisdiction. Other possible Board actions which you may wish to consider recommending follow: A. Restriction on How Tobacco Can Be Sold 1. The county imposes cigarette free zones within at least one mile of high schools, colleges, etc. 2. The county bans cigarette vending machines. 3. The county permits or licenses only certain businesses, such as pharmacies, to sell tobacco. 4. The county requires any business selling tobacco to purchase and post next to tobacco displays large signs depicting and explaining the health consequences of tobacco use. A-41 8181 261 � r J � S. The Board directs its law enforcement departments to strictly enforce all existing state and local laws and ordinances regarding the sale and use of tobacco. In conjunction with this, the Board uses its influence to encourage all city councils of the county to take similar action. Vending machines which are accessible to minors should be a major focus of enforcement. Schools should be required to enforce restrictions on smoking. B. County Employees and Buildings 1. The county insures that there are stop smoking clinics available to all county staff. 2. The county negotiates special non-smoking rates for non-smoking employees' health and life insurance and passes the savings onto the employees. 3. The county adopts non-smoking policies in county buildings which protect non-smoking workers from involuntary smoking. 4. The county bans the sale of tobacco in all county buildings. C. The county supports the Ventura County Pharmacists Association State initiative to tax cigarettes 1/2(t per pack for an education campaign aimed atminors and pregnant women. D. Ordinance restricting smoking in public places by designating no smoking areas. ASL:WB:rm 262
