SUBJECT: Declare intention to enter into a Joint Exercise of
Powers Authority between Contra Costa County, the City
of Antioch and the City of Brentwood for the Delta
Expressway in east Contra Costa County

Justification
I. RECOMMENDATION
1. Declare intention to enter into a Joint Exercise of Powers
Agreement with the City of Antioch and the City of Brentwood
for the purpose of preparing and certifying an environmental
document, preparing and adopting a precise alignment on the
preferred alternative and advocating on behalf of the Delta
Expressway.
2 . Direct staff to proceed with the environmental documentation
prior to execution of the Joint Exercise of Powers
Agreement.
II. FINANCIAL IMPACT
The County's share, estimated at $195, 000, will be funded
through the Countywide Area of Benefit, the Oakley/North
Brentwood Area of Benefit, and the Discovery Bay Area of
Benefit.

III. REASONS FOR RECOMMENDATION/BACKGROUND
In May 1987, Phase I of the East County Corridor Study was
authorized when the County entered into an agreement with
Alameda County, the Contra Costa Water District and the cities of
Antioch, Brentwood and Livermore to jointly plan a transportation
corridor from Highway 4 in Antioch to I-580 in the Livermore
area. Phase I of the study identified and evaluated alternative
alignments for the regional transportation corridor and resulted
in the recommendation of a "preferred corridor" by the Steering
Committee in February 1988 .
Phase II was intended to involve a more detailed environmental
analysis of the alternative alignments and the certification of
an environmental document for the preferred alignment. After
completion of that phase, the local agencies would be in a
position to adopt precise alignments and begin protecting right
of way.
Alameda County and the City of Livermore have indicated that
they choose to use their resources on more pressing priorities.
However, due to existing operational problems and increased
traffic volumes and congestion along Highway 4 in east Contra
Costa County, the Steering Committee members from Antioch,
Brentwood and the County have identified the need to proceed with
the EIR for the portion of the proposed transportation corridor
from Antioch to Brentwood, including connections to Highway 4 at
each end, commonly known as Delta Expressway. Additionally,
pending land proposals in east Contra Costa County may diminish
options to establish the proposed transportation routes
acknowledged in local general plans.
For these reasons, the County and the cities of Antioch and
Brentwood need to advance the state of readiness of the Delta
Expressway project. The Joint Exercise of Powers Agreement will
set up an Authority to prepare and certify an environmental
document, prepare and adopt a precise alignment and advocate for
the Delta Expressway. Once a precise alignment is adopted by the
Authority, the County will be able to protect or acquire the
right of way under the provisions of the Subdivision Map Act.
The proposed agreement is in legal review which will take some
time for completion. With the Board's declaration of intent to
enter into a joint exercise of powers agreement with the Cities
of Antioch and Brentwood, staff can proceed with the
environmental documentation for Delta Expressway prior to
executing the agreement.
The Cities of Antioch and Brentwood will be taking similar
actions.
IV. CONSEQUENCES OF NEGATIVE ACTION
Failure to declare intention to enter into the agreement will
delay a concerted planning effort for the Delta Expressway and
may result in fewer options for a transportation corridor.
