SUBJECT: LEASE - 30 DOUGLAS DRIVE, MARTINEZ �`�'� '�1
SPECIFIC REQUEST(S) OR RECOMMENDAT16N(S) & BACKGROUND AND JUSTIFICATION
I. RECOMMENDATION
AUTHORIZE the Director of General Services to EXECUTE, on
behalf of the County, a Subordination, Non-Distrubance and
Attornment Agreement and a Completion Agreement with Bank of
America, for the premises at 30 Douglas Drive, Martinez which
are leased from Vista Oaks.
II. FINANCIAL IMPACT
None.
III. REASONS FOR RECONllUKNDATIONS/BACKGROUND
The County has entered into a lease with Vista Oaks for the
premises at 30 Douglas Drive, Martinez. In order for Vista
Oaks to obtain construction financing for the project, a
Subordination, Non-Disturbance and Attornment Agreement is
required. The lease provides for the County to execute such
an agreement if required.
Bank of America also requires .the County to execute a
Completion Agreement in which the County agrees to provide
management services for completion of construction in the
event Vista Oaks is unable to do so. This is in accordance
with the terms of the Lease and .does not obligate payment of
County funds.
