III. REASONS FOR QN BACEO[lND
By resolution dated January 21, 1958, the Board of Supervisors of Contra
Costa County gave assurances of local cooperation to the Corps of Engineers
for the Walnut Creek Project. Among these assurances are requirements to
pay in cash 7.4 percent of the Federal project construction cost and to
provide for the relocation of all roads, bridges and utilities required for
the project. The Corps of Engineers has agreed to include relocation work
in the Federal project at 100 percent local cost to be paid as "Contributed
Funds Other."
On August 26, 1986 the Board of Supervisors approved and executed a Joint
Exercise of Powers Agreement with the City of Walnut Creek which obligated
the Flood Control District to pay 7.4 percent of the cost of a channel cover
funded by the City and included in the Federal project as a "Contributed
Fund Other" item.
Under current State law the local costs of relocation work required for the
Sari Ramon Bypass and the Upper Pine Creek Projects are 100 percent and 90
percent reimbursable, respectively, by the Department of Water Resources.
IV. CONSEQUENCES OF NEGATIVE ACTIM
Failure to authorize the issuance of a warrant would be cause for the Corps
of Engineers to stop further work on the Walnut Creek Project.
