Army Corps of Engineers, for the Walnut Creek Project, Flood Control Zone No. 3B, Project No. 7520-688687 Specific Request(s) or Reoommendation(s) & BackTmuni & Justification I. RlDOOMMENDATION AUTHORIZE the County Auditor-Controller to issue two (2) warrants totalling $379,889.67 payable to the Finance and Accounting Officer, USAED, Sacramen- to, as the District's 7.4 percent share of the Federal project cost and the District's share of contributed funds other costs, for the period October 1988 through December 1988, for the Walnut Creek Project. The warrants shall be prepared with reference numbers and in amounts as follows: Warrant #1 Cost Account #96X8862-FW196 for $125,000.00 Warrant #2 Cost Account #96X8862-FW197 for $254,889.67 II. REASONS FOR QN BACE�O[lND By resolution dated January 21, 1958, the Board of Supervisors of Contra Costa County gave assurances of local cooperation to the Corps of Engineers for the Walnut Creek Project. Among these assurances are requirements to pay in cash 7.4 percent of the Federal project construction cost and to provide for the relocation of all roads, bridges and utilities required for the project. The Corps of Engineers has agreed to include relocation work in the Federal project at 100 percent local cost to be paid as "Contributed Funds Other." On August 26, 1986 the Board of Supervisors approved and executed a Joint Exercise of Powers Agreement with the City of Walnut Creek which obligated the Flood Control District to pay 7.4 percent of the cost of a channel cover funded by the City and included in the Federal project as a "Contributed Fund Other" item. Under current State law the local costs of relocation work required for the Sari Ramon Bypass and the Upper Pine Creek Projects are 100 percent and 90 percent reimbursable, respectively, by the Department of Water Resources. IV. CONSEQUENCES OF NEGATIVE ACTIM Failure to authorize the issuance of a warrant would be cause for the Corps of Engineers to stop further work on the Walnut Creek Project.
