HomeMy WebLinkAboutMINUTES - 09201988 - T.6 THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA T. 6 Adopted this Order on September 20, 1988 by the following vote: AYES: Supervisors Powers, Fanden, McPeak and Schroder NOES: None ABSENT: Supervisor Torlakson ABSTAIN: None --------------------------------------------------------------------- --------------------------------------------------------------------- SUBJECT: Hearing On Appeal Filed By The Green Valley Blind Homeowner' s Association Relative To Approval Of Land Use Permit 2007-88 (Rebecca Crowell, Applicant and Owner) In The Danville Area. This being the time heretofore noticed by the Clerk of the Board of Supervisors for hearing on the appeal of the Green Valley Blind Homeowner' s Association from the decision . of the San Ramon Valley Regional Planning Commission, acting as the Board of Appeals, granting with conditions the request by Rebecca Crowell (applicant and owner) for approval of Land Use Permit 2007-88 to establish a private (ballet) school within an existing residence in the Danville area. Mary Fleming, Community Development Department, commented on the the appeal, the history of the Land Use Permit application,and described the site involved. She commented on the San Ramon Valley Regional Planning Commission approval with a two year time limit before a new application would be required, limiting the class size to ten students at any one time and limiting the hours of operation to times they felt would have the least amount of impact on the neighborhood, limiting the number of staff persons and disallowing any special events being held on the site. She advised that the staff recommendation is that the appeal be denied and that the San Ramon Valley Regional Planning Commission decision be upheld at this time. The public hearing was opened and the following people appeared to speak: George McCulley, 1890 Green Valley Road Blind, Danville, representing the Green Valley Road Blind Homeowner' s Association, commented on the issues for the appeal including the people who live on the road not using the ballet studio, the parking lot, and the lack of the application for a permit to operate the ballet studio. He Presented pictures of the site to the Board of Supervisors. He also referred to a letter sent by the dance studio dated June 22, 1988 . He commented on the lowering of property values and the inconsistency with the rural residential objectives set by the 1977 San Ramon Area General Plan, the traffic and parking problems, the horse trail, and requested that the Board deny the application for the Land Use Permit. Rebecca Crowell, 1801 Green Valley Road, Danville, director of Ballet and Theater Arts, applicant and owner, commented on issues including the landscaping, the parking area,. the location of a sports court, the berm surrounding their property, the traffic study, the equestrian trail, an overview of the school, and requested approval for the Land Use Permit. The following people spoke in favor of approving .the Land Use Permit and denying the appeal: Fae C. E1 Sobrante, Danville; George McCully spoke in rebuttal. Supervisor Schroder recommended leaving the record open for written testimony until Friday, September 23, 1988 at 5: 00 p.m. and deferring decision on this matter until Tuesday, September 27 , 1988 on the determination calendar. He commented on the issues in question and the testimony on the land use permit, indicating that he would like to take all testimony into consideration, visit the site, and defer the decision to next Tuesday. , Supervisor Powers commented in favor of approving the Land Use Permit. Supervisor McPeak requested Mr. and Mrs. Crowell to provide a copy of the California State Licensing on their child care facility. She also commented on issues including the concern on the manner in which the matter had come to the Board and that good faith had been shown by suspending the operation of the school. She commented on the propriety of this land use, minimal impacts of traffic from the school, and the lack of negative effect on property values. She expressed support of the Alamo Improvement Association' s recommendations and suggested one further consideration in those conditions that there should be a one year review by staff, a staff report to the Board to see that there has been compliance and that the berming and landscaping should be in place within that year. Therefore, IT IS BY THE BOARD ORDERED that the hearing on the above matter is CLOSED with the record to remain open for written testimony until 5: 00 p.m. on Friday, September 23 , 1988; and decision on the matter is DEFERRED to the determination calendar on September 27, 1988 .
