McPeak Date: September 1, 1988 Tom Torlakson From: Phil Batchelop`_, Subject: Trial Court Funding/ County Administrator Property Tax Transfer to No 'and Low Cities Prior to adjourning this morning, the Legislature sent the Governor SB 612 (Presley) which changes the Trial Court Block Grant Program and AB 1197 (W. Brown) which changes the transfer of property taxes to the no- and low-property tax cities. As is true with most legislation, these bills ended up being a compromise. While the County gained a good deal from where we were a few weeks ago, it certainly was not as much as we had hoped for. Conversely, the cities lost more than they had wanted to. You should particularly be aware that Clay Jackson and his staff lobbied very hard for this County and were instrumental in obtaining several of the provisions which we might not otherwise have achieved. In particular, Mr. Jackson himself was personally involved last night after it appeared that the whole compromise might blow up as a result of one particular irrelevant amendment that was added by the Conference Committee. While we have not yet had a chance to study all of the final language that was approved and sent to the Governor, it appears that Contra Costa County will net about $9 million a year through 1994-95 . At that point, the no and low provisions become fully operational and the County' s net benefit may drop to about $7 . 8 million and then slowly grow again thereafter for at least several years. Eventually, it appears that the property tax transfer will erode the benefit to the County. However, this will not happen for perhaps 15 , to 20 years. In addition, a number of key legislators seem determined to reopen the whole formula for the distribution of property taxes over the next several years and, hopefully, will reform this whole process before 1995 . Board Members September 1 , 1988 Page 2 With additional funds we will undoubtedly have to commit to the courts, it is likely that we will still be short upwards of $4 million in terms of opening the new West County Justice Center on schedule. Attached for your information are two sheets prepared by the Legislative Analyst' s Office based on the Conference Committee' s deliberations on AB 1197. One, shows the block grant to the County, the property tax transfer to the no and low cities, and the net benefit to the County. The other sheet shows the property tax transfer to each of the no and low cities over the next ten years. Among the most significant achievements from the County' s perspective are the following: 1 . The County will receive a "net" block grant and be allowed to keep all fine and forfeiture revenue, rather than returning this revenue to the State. We will receive an annual block grant for each judicial position of $212 ,000 plus a cost-of-living ., adjustment equal to the salary increase granted to State employees in the prior fiscal year. This is of considerable benefit to the County because we will be able to keep all growth in the fines and forfeitures and not have to return any of this revenue to the State. 2 . The transfer of property tax to the no and low cities is reduced from 100 of the property tax generated in the city, phased in over 10 years to 70 of the property tax phased in over seven years. This provision will save the County $8 . 4 million in property taxes in the tenth year alone! The Board of Supervisors does not have to inform the State about its decision to opt in until January 15, 1989 . We will presenta more detailed report for the Board' s information as soon as we have had an opportunity -to complete our analysis of these two very important pieces of legislation.
