District on Receiving the Award )
of Excellence from U.S. EPA )
WHEREAS, the U.S. Environmental Protection Agency presents
the Operations and Maintenance Excellence Awards to recognize those
communities with outstanding accomplishments in managing and operating
wastewater treatment plans and draws attention to the important role
that well-run treatment plants play in protecting water quality;
WHEREAS, on August 19, the U.S. Environmental Protection
Agency presented the Delta Diablo Sanitation District with an
Operations and Maintenance Excellence Award for its sewage treatment
plant;
WHEREAS, John Wise, Deputy Regional Administrator for Region
9 of the Environmental Protection Agency, presented the award at the
Annual Conference of the California Association of Sanitation
Agencies;
WHEREAS, the Delta Diablo Sanitation District earned its
Excellence Award by maintaining an outstanding compliance record; an
exceptionally high quality effluent; sound financial management;
innovative management and operation practices; advanced planning; and
a truly exceptional safety program.
WHEREAS, the district is one of only two award winners in
the category of medium-size secondary treatment plants and one of the
only 17 recipients in EPA' s Region 9, which includes approximately
3 ,000 municipal treatment plants and includes the states of Arizona,
California, Hawaii, and Nevada, as well as the outer Pacific Islands;
NOW, THEREFORE, BE IT RESOLVED THAT THE BOARD OF SUPERVISORS
OF CONTRA COSTA COUNTY, CALIFORNIA, does hereby commend the Delta
Diablo Sanitation District for its exceptional management and
operation of its treatment plant and congratulates the district on
receiving the Award of Excellence from the Environmental Protection
Agency;
PASSED by unanimous vote of the Board Members present on
this 13th day of September 13 , 1988.

6 The Board of Supervisors of Contra Costa County, California by vote
7 of two-thirds or more of its members, RESOLVES that:
8 Pursuant to Government Code section 25350.5, Contra Costa County
9 intends to construct a water well system project, a public improvement in the
10 Knightsen area and, in connection therewith, acquire fee title to certain real
11 property.
12 The property to be acquired consists of one ,parcel, 24,200 square feet
13 of land, and is generally located in the Knightsen area. The said property is
14 more particularly described in Appendix "A", attached hereto and incorporated
15 herein by reference.
16 On August 16, 1988, this Board passed a resolution of intention to
17 adopt a resolution of necessity for the acquisition by eminent domain of the
18 property described in Appendix "A" (Resolution No. 88/532) and fixing 10:30 a.m.
19 September 13, 1988, in its Chambers in the Administration Building, 651. Pine
20 Street, Martinez, California, as the time and place for the hearing thereon.
21 The hearing was held at that time and place, and all interested parties
22 were given an opportunity to be heard and based upon the evidence presented to
23 it, this Board finds, determines and hereby declares the following:
24 1 . The public interest and necessity require the proposed project; and
25 2. The proposed project is planned and located in the manner which
26 will be most compatible with the greatest public good and the least.private
27 injury; and

3. The property described herein is necessary for the proposed pro-
2 ject; and.
3 4. The offer required by Section 7267.2 of the Government Code was
4 made to the owner or owners of record.
5 The County Counsel of this County, or any Counsel associated by him, is
6 hereby AUTHORIZED and EMPOWERED:
7 To acquire in the name of the Contra Costa County, by condemnation, the
8 fee title to the property described in Appendix "A", in accordance with the' pro-
9 visions for eminent domain in the Code of Civil Procedure .and the Constitution
10 of Calif ornia.'
11 To prepare and prosecute in the County's name such proceedings in the
12 proper court as are necessary for such acquisition.
13 To deposit the probable amount of compensation, based on an appraisal,
14 and to apply to said court for an order permitting the County to take immediate
15 possession and use said real property for said public uses and purposes.
16 PASSED and ADOPTED on September 13, 1988, by the following vote:
17 AYES: Supervisors Powers, Fanden, McPeak, Torlakson, and Schroder

Contra Costa, State of California, being a portion of the southwest one
quarter of the southeast one quarter of Section 32, R2N, ME, MDBM, des-
cribed as follows:
Beginning at the most southerly corner of that parcel of land described in
the grant deed to Albert G. Bello, et al. and recorded at Page 948 Book
08294 of the Official Records of the County of Contra Costa, State of
California on April 20, 1977; thence southeasterly along the northeasterly
line of Knightsen Avenue south 470 43' 00" east 220.00 feet, thence north
420 17' 00" east 110.00 feet, thence north 470 43' 00" west 220.00 feet,
thence south 42o 17' 00" west 110.00 feet to the point of beginning,
containing 24,200 square feet more or less.
