SUBJECT: Solid Waste Joint Powers Authority
The Board received the attached report dated. August 3 ,
1988 from the Solid. Waste Commission recommending the formation of
a Countywide Solid Waste Joint Powers Authority (JPA) .
Supervisor Tom Powers expressed concern about the
funding mechanism for the Authority. He stated that in addition to
tipping fees, other sources of income should be specified, such as
surcharges on franchise fees of sanitary districts and cities.
Supervisor Sunne McPeak supported the concept. of the
Joint Powers Authority but expressed the belief that because the
County has the responsibility of enforcing the Solid Waste
Management Plan there should be more than one County representative
on the JPA.
Supervisor Tom Torlakson stated that he agreed with the
comments of Supervisors Powers and McPeak, and moved approval of
the recommendations of the Solid Waste Commission as amended to
incorporate the recommendations of Supervisors Powers and McPeak.
Supervisor Nancy Fanden advised that she would abstain
from voting since she has some concerns about the JPA proposal.
Supervisor Robert Schroder voted on this matter upon
advice of County Counsel that he could. participate.
IT IS BY THE BOARD ORDERED that the recommendations of
the Solid Waste Commission on the formation of a Countywide Solid
Waste Joint Powers Authority are APPROVED as amended relative to
funding mechanism and. County representation.

RECOMMENDATION
Accept recommendations from the Solid Waste Commission on the
formation of a countywide Joint Powers Authority in the near
future to address solid waste issues in Contra Costa County.
FINANCIAL IMPACT
The majority . of the cost for the operation of the Joint Powers
Authority would be eligible for the solid waste planning tipping--
fee currently being assessed to landfill operators. If any
additional and/or ineligible expenses are incurred, by the Joint
Powers Authority, member agencies would share in the cost.
REASON FOR RECOMMENDATION%BACKGROUND
Approximately two months ago the Solid Waste Commission appointed
Commission members to a subcommittee to address the need for and
the feasibility of the formation of a countywideJoint Powers
Authority. This subcommittee, consisting of. Roy Hawes, Mary
Rocha and Everett Jenkins , met two times to discuss this issue:
Following a report to the Commission on their findings, the
Commission determined that there was a need to '. form a Joint
Powers Authority, a single body, to address Contra Costa County
solid waste issues, some of which include solid waste export,
landfill siting, and other solid waste related matters that cur-
rently exist in the County.
The Commission determined that there was a need for more direct,
coordinated involvement by all affected agencies. The Commission
had concerns regarding the various efforts now being made by
governing bodies, committees, agencies, and groups'; to solve the
many solid waste related questions that currently; exist in the
County. The Commission also envisioned that the Solid Waste
Commission could eventually transition into a policy body of the
Joint Powers Authority, once some of the immediate questions,
such as waste export have been addressed and answered. The
attached letter from Avon Wilson, Chair of the Solid Waste Com-
mission," outlines the recommendation by the Commission regarding
the formation of a countywide Joint Powers Authority.

Dear Supervisor Schroder and Members of the Board:
The Solid Waste Commission has witnessed the disarray of franchising agencies
attempting to deal with solid waste export, landfill siting, and other solid
waste related issues. There is a clear need for more direct, coordinated in-
volvement of all affected agencies. The Solid Waste Commission recommends. that
a countywide Joint Powers Authority (JPA) to address solid waste issues be
formed in the near future. This recommendation was authorized by the Solid
Waste Commission at our August 3, 1988, meeting. We see the Solid Waste Com-
mission transitioning into a policy body of the JPA, once the immediate crisis
of solid waste export is resolved.
The Commission sees the authorities of the JPA initially limited. The JPA would
be a means to formalize relations between affected agencies and to perform tasks
such as developing recommendations, studies, and policies that would have more
force and stature than the current Solid Waste Commission. The authority ini-
tially would have no control over the waste stream, no ability to amend or
revise the Solid Waste Management Plan, and no powers to operate or own solid
waste facilities. Additional authorities of the JPA will be considered once a
JPA has been established. One of the initial studies that will be needed is to
identify a future landfill site if existing, proposed landfill sites have not
been approved..
The Solid Waste Commission is cognizant of the existence of the Solid Waste
Action Team (S.W.A.T. ) and the Memorandum of Understanding (M.O.U. ) as proposed
by the Public Managers' Association. These groups will probably have a short
life and will be addressing a very specific issue, solid waste export. We
believe these groups. provide an ideal forum to discuss a future countywide JPA,
since all the informed parties to the issue will be assembled. The Commission
feels that the S.W.A.T. , the M.O.U. group and the Solid Waste Commission can be
transformed, in the future, into one JPA body.

The following are some provisions initially recommended for the JPA:
1. Membership would include all cities including those which do not
franchise, all franchising sanitary districts and the County. Each
agency would have one member on the policy board. If all agencies
choose to participate, the JPA would have 27 members.
2. An 11-member steering committee would be formed to manage the day-to-
day operations of the JPA. Two elected officials from each supervisor-
ial district would be appointed by the policy board, and the Board of
Supervisors would appoint one County Supervisor. The steering com-
mittee would meet on a regular basis (perhaps monthly) , and the policy
board would meet as required to appoint the steering committee, ratify
a work plan, and an annual budget.
3. It is envisioned that most of the cost for the JPA would be eligible
for the solid waste planning tipping fee currently being assessed. If
additional ineligible expenses are incurred, member agencies would
share in the cost.
The Solid Waste Commission recommends that the Board of Supervisors endorse, in
concept, the JPA. The Commission also requests authority to make presentations
regarding the JPA to the S.W.A.T. and the M.O.U. group as well as other agencies
in the near future. The time of such presentation should be scheduled so as, to
not interfere with the pressing need to put all efforts towards arranging for
export agreements.
Representatives from the commission will be present at the Board meeting to
answer any questions that you may have.
