Z TO BOARD OF SUPERVISORS FROM: Mark Finucane, Health Services Director ""' '` Costa DATE: July 29, 1988 yyoio Couly SUBJECT: Ordinance 88-26 Impact SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION RECOMMENDED ACTION : Accept report from Health Services Director in response to Supervisor McPeak' s request of June 28', 1988 regarding the impact of Ordinance 88-26. FINANCIAL IMPACT: None BACKGROUND : In response to Supervisor McPeak' s June 28, 1988 request, the Environmental Health ;Division has reviewed the impacts of Ordinance 88-26, which prohibits land disposal of liquid hazar- dous waste effective July 1, 1988. Our review included discussions with Regional Water Quality Control Board staff, as well as discussions with staff at each facility. In addi- tion to ascertaining the date that disposal to land ceased, we reviewed compliance with the Toxic Pit Cleanup Act (TPCA) , and the current disposition of those wastestreams that were formerly disposed of to land. A summary of the responses to our survey follows. BAY STANDARD , Brentwood Disposal to the pond was discontinued in Fall , 1986. Wastes are now hauled to Kettleman. The pond currently complies with the July 1, 1988 deadline for deinventory mandated by TPCA for ponds within 1/2 mile of a potential drinking water source. Rain threatens a TPCA violation. The closure plan before the Central Valley Regional Water Quality Control Board contains no monitoring program; correction is being sought by the Board through a Cleanup and Abatement Order. CHEMICAL AND PIGMENT, Pittsburg Waste was last disposed of to the pond on May 1, 1988. Materials formerly sent tothe pond are recycled in process. (Materials were scavenged from the pond for recycle previously. ) The pond is dry at this time; the pond is subject to the July 1, 1988 deadline, which was met. The closure plan is scheduled for implementation in August. CHEVRON CHEMICAL, Richmond Of the 13 ponds at this facility, several collect storm runoff. Correspondingly, the latest disposal to any of the Chevron Chemical ponds was with the most recent rain. Wastes for- merly disposed to the ponds are currently incinerated or no longer generated. The �ponds may be dry by the January 1, 1989 deadline. The ponds will be closed rather than retro- fitted. CHEVRON , U.S.A. , Richmond The hydrochloric acid ponds have not received waste since 1986; the Pollard pond has not been used since the 1960' s. The wastes formerly disposed of in these ponds are no" longer produced. The HF ponds will meet the January 1, 1989 deadline, while the Pollard pond pro- bably won't. The ponds are scheduled for closure rather than retrofit. DOW CHEMICAL, Pittsburg Disposal to the six ponds was halted in October, 1987. Some of the:waste streams formerly directed to the ponds have been eliminated. Others are being treated for recycle. Two of the ponds were exempted from the July 1, 1988 TPCA deadline; the other four have been dried and solidified. The remaining ponds will meet the January 1, 1989 deadline. Ultimate clo- sure may be completed by Spring, 1989. GENERAL CHEMICAL, Richmond Nonhazardous liquid waste is still being disposed of in the pond. General Chemical expects to have a treatment tank in service to replace the pond in early October, 1988. At that time, the hazardous sludges will be removed from the pond in preparation for closure. IMPERIAL WEST, Antioch Neither pond has received waste for at least six months. The San Francisco Regional Water Quality Control Board has found that the ponds are not subject to TPCA. I .T. CORPORATION , Martinez The ponds have not received wastes since before November 30, 1987. According to San Francisco Regional Water Quality Control Board staff, it is unlikely that sludges will be dry by January 1, 1989. A closure plan has not been approved for the ponds. I.T. is seeking a variance as permitted by Section VI of the County Ordinance. PG&E, Antioch The three ponds at the Antioch Power Plant last received wastes in 1985. Liquid wastes are now treated on site; the treated liquid is discharged under NPDES permit, while precipi- tated metals are transported to Chemical Waste Management. It is expected that the ponds will be dry before the January 1, 1989 deadline. PG&E is awaiting EPA approval on final closure. PG&E, Pittsburg All five Class I ponds are currently dry and are being desludged. The oil sludge pond is to be permanently closed. The remaining ponds have been permitted for retrofit and con- tinued service. Disposal of liquid hazardous waste to the ponds was phased out in'' February, 1988. Wastes formerly impounded are now transported to an offsite recycler or discharged under NPDES permit. RICHMOND SANITARY, Richmond Hazardous waste disposal to the pond was suspended in 1983. Use for disposal of Class II leachate continued until 1984. The pond is currently 70% dry. Ultimate closure may entail capping dried sludges in place. STAUFFER, Martinez Disposal to the ponds ceased in April , 1988. Liquid waste is currently handled in; an onsite treatment plant. It is probable that the ponds will not be free of liquids by January 1, 1989.
