RESOLUTION OF INTENTION TO ADOPT RESOLUTION OF NECESSITY
The Board of Supervisors, as the Governing Body of
Contra Costa County Flood Control and Water Conservation District
RESOLVES THAT:
It intends to adopt a Resolution lof Necessity for the
acquisition by eminent domain of real property in the Oakley
area, for a storm drain pipeline, . a ''rpublic improvement, which
property is more particularly described in Appendix "A" attached
hereto.
This Board will meet on Tuesday, October 4, 1988, at
11 : 00 a.m. in the Board's Chambers, County Administration
Building, 651 Pine Street, Martinez, ', California, to hear those
persons whose property is to be acquired land whose names and
addresses appear on the last equalized County assessment roll,
and to consider the adoption of the Resolution. The Contra Costa
County Real Property Division is DIRECTED to send the following
notice to each such person by first-class mail:

The Board of Supervisors, as, the Governing Body of the
Contra Costa County Flood Control and Water Conservation Dis-
trict, declares its intention to consider the adoption of a
Resolution of Necessity for the acquisition by eminent domain of
real property in the Oakley area, for+', a storm drain pipeline, a
public improvement, which property is more particularly described

Orig. Dept.. : Public Works (RP) as action taken and entered on the minutes of the
CC: County Counsel Board of Supervisors on the date shown.

in Appendix "A" attached hereto. The Board will meet on Tuesday,
October 4, 1988, at 11: 00 a.m. in the Board's Chambers at 651
Pine Street, Martinez, . California, to consider the adoption of
the Resolution. Each person whose property is to be acquired and
whose name and address appears on the last equalized County
assessment roll has the right to appear at such hearing and be
heard on:
1. Whether the public interest and necessity require
the project; and
2 . Whether the project isplanned and located in the
manner that will be : most compatible with the
greatest public good ands;: the least private
injury; and
3 . Whether the property ,,sought to be acquired is
necessary for the project; and
4. Whether the offer of just compensation required
by Section 7267.2 of the Government Code has been
made to the owner of record.

APPENDIX "A"
All that real property situated in the unincorporated area of the County of
Contra Costa, State of California, described as follows:
A portion of the southwest 1/4 of Section 23 of Township 2 north, Range 2
east, Mount Diablo Base and Meridian, further described as follows:
PARCEL, CNE: Permanent Easement
A strip of land 12 feet wide, the centerline of which is described as
follows:
Commencing at a 3/4" iron pipe with tag L.S. 2112 set at the northwest
corner of said southwest 1/4, as said 3/4" iron pipe is shown on that
certain record of survey filed May 14, 1971, in Book 53 of L.S.M., at Page
40, in the Office of the Contra Costa County Recorder; thence southerly
along the westerly line of said southwest 1/4 south 00 35' 05" east, 860.19
feet to a point 6.00 feet northerly, right angle measurement, from the
westerly prolongation of the northerly boundary line of "Diane Park" as
filed May 26, 1949, in .Book 37 of Maps at Page 36, in the Office of said
County Recorder; thence along a line parallel with last said northerly
boutxlary line south 880 46' 55" east, 30.00 feet to the point of beginning.
Thence frcan said point of beginning, continuing along said parallel line,
south 880 46' 55" east, 1275.84 feet; thence, leaving said parallel line,
north 230 39' 00" east, 102.61 feet to the southerly line of the A.T. & S.F.
Railroad right of way as it presently exists. The side lines of said strip
to be shortened or lengthened to terminate at.the southerly line of the A.T.
& S.F. Railroad right of way.
Containing 16,541 square feet of land more or less.
PARCEL TWO: Temporary Construction Easement (To expire March 31, 1989 or on
ccau>pletion of construction, whichever Comes first)
A strip of land 25 feet wide, the centerline of which is 18.50 feet norther-
ly, right angle measurement, froth the centerline of the herein above
described Parcel One. The side lines of said strip to be shortened or
lengthened to terminate at the southerly line of the A.T. & S.F. Railroad
right of way as it presently exists.
Containing 33,848 square feet of land more or less.
