Adopted this Resolution on September 13 , 1988 by the following
vote:

SUBJECT': Approval of the Final Map and Subdivision Agreement and
Declaring Certain Roads as County Roads for Subdivision
6777, Concord Area.
The .Public Works Director having reported that the off-site
drainage improvements required by the Ordinance code involves
construction of a storm drain line through three properties
(Tosco Corporation, EBMUD and Contra Costa Water District)
downstream of adjacent Subdivision 5882 in an area which the Army
Corps of Engineers has designated as wetlands. On August 16,
1988 this Board approved the final map of Subdivision 5882 along
with a bonded drainage improvement agreement covering the
installation of the downstream drainage.
The Public Works Director having further reported that the
installation of the off-site subdivision drainage improvements
required approval of the Army Corps of Engineers which has not
been obtained yet and recommends that issuance of building
permits be withheld until the drainage improvements bonded by
Subdivision 5882 are installed and accepted as complete. The
same requirement was made for Subdivision 5882.
The Public Works Director having further reported that
subdivision improvements were accepted by this Board as complete
on June 7, 1988 and recommends the streets be accepted for
maintenance.
The following documents were presented for Board approval
this date:
The Final Map of Subdivision 6777, property located in the
Concord area, said map having been certified by the proper
officials.
A Subdivision Agreement with Allied Investments, subdivider,
whereby said subdivider agrees to complete all improvements as
required in said Subdivision Agreement within one year from the
date of said agreement.
Said documents were accompanied by:
I. Security to guarantee the one year warranty of the road
and drainage improvements as required by Title 9 of the
County Ordinance Code, as follows:
A. Cash deposit (Auditor's Deposit Permit No. 123995,
dated May 6, 1987) in the amount of $1, 600 made by
Concord Industrial Park.
B. Additional security in the form of a corporate
surety bond dated April 15, 1987 , and issued by
Automotive Insurance Company (Bond No.. AIC-580718)
with Allied Investments as principal, in the
amount of $159, 000 for faithful performance and
$80, 300 for labor and materials.

II. Letter from the County Tax Collector stating that there
are no unpaid County taxes heretofore . levied on the
property included in said map and that the 1987-88 tax
lien has been paid in full and the 1988-89 tax lien,
which became a lien on the first day of March, 1988, is
estimated to be $122,900.
III. Security to guarantee the payment of taxes as required
by Title 9 of the County Ordinance Code in the form of
a surety bond, No. TPI-616395, issued by Transamerica
Premier Insurance Company with Concord Industrial Park
as principal, in the amount of $122, 900 guaranteeing
the payment of the estimated tax;
NOW THEREFORE BE IT RESOLVED that said subdivision, together
with the provisions for its design and improvement, is DETERMINED
to be consistent with the County's general and specific plans.
BE IT FURTHER RESOLVED that said Final Map is APPROVED and
this Board does not accept or reject on behalf of the public any
of the streets, paths, or easements shown thereon as dedicated to
public use.
BE IT FURTHER RESOLVED that said Subdivision Agreement is
also APPROVED.
BE IT FURTHER RESOLVED that the hereinafter described roads,
as shown and dedicated for ppublic use on the Final Map of
Subdivision 6777 filed October 28 , 1988 , in Book 326 of Maps
at page 50- 51 , Official Records of Contra Costa County, State
of California, are ACCEPTED and DECLARED to be County roads.

BE IT FURTHER RESOLVED that upon the recommendation of the
Public Works Director, issuance of all building permits shall be
withheld until the off-site storm drainage lines are constructed
and accepted as complete.
