Seeno Construction (Owner) , located on the west side of Zinfandel Drive ( 143 ' frontage) about 105 feet north of the Zinfandel Drive/Chianti Way intersection in the Oakley area. SPECIFIC REQUEST(S) OR RECOMMENDATIONS(S) & BACKGROUND AND JUSTIFICATION RECOMMENDATIONS - 1. Accept the environmental documentation prepared for this project as being adequate. 2. Deny the appeal and uphold the decision of the East County Regional Planning Commission approving Subdivision 7064 with conditions of approval hereto attached. BACKGROUND This application was filed on March 7, 1988. After taking testimony at hearings on May 23 , 1988, and June 13 , 1988, the East County Regional Planning Commission approved Subdivision 7064 with a requirement , that the development be served by a public road and circular turnaround along the sites ' northerly property line. The original proposal had been for a private road along the southerly property line. The applicant had modified the request, proposing a private road, 20 feet wide within a 25 foot wide access easement with hammerhead turnaround along the northerly property line. The specific conditions of approval involved in the appeal are Conditions 11. B. , C. and D (conditions attached) . Seeno Construction THE BOARD OF SUPERVISORS COUNTY ADMINISTRATOR BY DEPUTY AB:plp CONDITIONS OF APPROVAL FOR SUBDIVISION ;_7.064 1. This subdivision is granted for four lots. All conditions unless otherwise stated shall be adhered to prior to filing the Final Map. 2. Comply with the Park Dedication Ordinance. 3. Potable water from a Public Water Agency shall be provided, and prior to Final Map approval , the applicant shall provide proof that each parcel has a guaranteed connection to such a system. 4. All utilities shall be placed underground. 5. An average lot width variance of 3.5 feet (55.6 feet depicted on proposal , 60 feet required by County Ordinance) is approved. 6. Sewage disposal serving the properties concerned in this application shall be provided by the Oakley Sanitary District. Each individual living unit shall be served by a separate sewer connection. The sewers located within the boundaries of the properties concerned shall become an integral part of the Oakley Sanitary district's sewerage collection system. 7. Should archaeological materials be uncovered during grading, trenching or other on-site excavation(s) , earthwork within 30 yards of these materials shall be stopped until a professional archaeologist who is certified by the Society for California Archaeology (SCA) and/or the Society of Professional Archaeology (SOPA) has had an opportunity to evaluate the significance of the find and suggest appropriate mitigation(s) , if deemed necessary. 8. The location of the abandoned "Massoni-De Martini" gas well shall be sur- veyed and depicted on the Final Map. 9. A structural setback consisting of a 3 foot radius relative to the aban- doned well head shall be observed. 10. The following statement shall be recorded at the County Recorder's Office for lot number 1 to notify future owners of the said lot that there is an abandoned gas well present. "This document shall serve as notification that you have purchased property on which lies an abandoned gas well , known as the "Massoni-De Martini" well that was abandoned in August, 1982, prior to which it produced natural gas. The abandonment and sealing of the well occurred under the regulation of the California Division of Oil and Gas. Additional information including location can be obtained from County File 7064 or the California Division of Oil and Gas." 11. Comply with drainage, road improvement, traffic and utility requirements as follows: A. In accordance with Section 92-2.006 of the County Ordinance Code, this subdivision shall conform to the provisions of the County Subdivision Ordinance (Title 9) . Any exceptions therefrom must be specifically listed in this conditional approval statement. Requirements of the Ordinance include the following: ' W 2 1. Undergrounding of all utility distribution facilities. 2. Conveying all storm waters entering or originating within the subject property to a natural watercourse having definable bed and banks or to an existing adequate storm drainage facility. Although the storm drainage system is shown on the submitted plan, comment on the system will be made when the improvement plans are submitted for review. 3. Prohibiting the discharging of storm waters to roadside ditches. 4. Submitting a Final Map prepared by a registered civil engineer or licensed land surveyor. 5. Submitting improvement plans prepared by a registered civil engi- neer, payment of review and inspection fees, and security for all improvements required by the Ordinance Code or the conditions of approval for this subdivision. These plans shall include any necessary traffic signage and striping plans for review by the County Traffic Engineer. Stop signs shall be required on the private roads at the entrance to the public roadways. 6. Installing, within a dedicated drainage easement, any portion of the drainage system which conveys run-off from public streets. B. Convey to the County, by Offer of Dedication,40 feet of additional right of way as required for the planned future road along the northerly line of the property. The dedication shall include a 45 foot radius cul-de-sac at its terminus. C. Construct the road along the northerly property line of this property to County public road standards with a minimum width of 28 feet and with a 35 foot radius cul-de-sac at its terminus. The road shall serve all lots in this subdivision. D. Submit a revised Tentative Map subject to the review of the Public Works Department, Road Engineering Division, and subject to the review and approval of the Zoning Administrator which shows the realigned, public road access to the proposed sites. E. Comply-with the requirements of the Bridge/Thoroughfare Fee Ordinance for the East/Central County Travel Corridor Area of Benefit and the Oakley Area of Benefit as adopted by the Board of Supervisors. F. Prevent storm drainage, originating on the property and conveyed in a concentrated manner, from draining across the sidewalks and driveways. G. Furnish proof to the Public Works Department, Engineering Services Division, of the acquisition of all necessary rights of entry, permits and/or easements for the construction of off-site, temporary or perma- nent, road and drainage improvements. 3 H. Comply with the drainage fee requirements for Drainage Area 29D as adopted by the Board of Supervisors. I. The applicant shall file a request for annexation to AD 1979-3 (LL-2) . The applicant should be aware of the following requirements: A. Comply with the Oakley Fire District requirements. B. Comply with the Building Inspection Department requirements.
