SUBJECT: Hearing Pursuant to AB 3014 Relating to the
Marshal/Sheriff Consolidation
SPECIFIC REQUEST(S) OR RECOMMENDATIONS) & BACKGROUND AND JUSTIFICATION
RECOMMENDATION:
Direct the County Administrator to fix Tuesday, August 16, 1988
at 11: 00 A.M. as the date and time for a hearing pursuant to AB
3014 if the bill has been signed by the Governor and chaptered by
the Secretary of State prior to August 16, 1988. Because this
item is not listed on the agenda for August 9, 1988, the Board by
a 4/5 vote will have to find that an emergency occurred in that
AB 3014 only went to the Governor after the agenda was posted.
BACKGROUND:
AB 3014 (Baker) was sponsored by the Board of Supervisors. it
provides the Board. and the court with the authority. to
consolidate the court-related functions of the Marshal and the
Sheriff if, following a hearing on the subject, the Board of
Supervisors makes a finding that there will be cost savings from
such a consolidation. Once the Board adopts such a finding an
election must be held among all of the Superior and Municipal
Court Judges regarding whether the consolidation should occur in
the Sheriff ' s Office or the Marshal' s Office. Once the results
of the election are transmitted to the Board of Supervisors, the
Board can proceed with the consolidation.
Because of impending vacation schedules, the judges would very
much like to hold the election on August 18. In order to do so
the Board would have to hold the hearing on August 16. However,
since the bill is still on the Governor' s desk at this point,
County Counsel has indicated that the Board should not actually
set the hearing until the bill has been signed and chaptered. In
order to accomplish this deadline it is recommended that the
Board delegate to the County Administrator the authority to fix
the hearing for August 16, 1988 if the legislation has been
signed and chaptered prior to August 16, 1988.
We will, therefore, determine whether the bill has been signed
and chaptered in time to post public notice of the hearing and to
advise the Sheriff, the Marshal, the Judges and the local

A.M. the hearing required by AB 3014. If the bill has not been
signed and chaptered by August 16 it will be necessary to put the
hearing over to at least August 23 .
