Bragdon Contra Director of Community Development Costa DATE: August 1, 1988 Courcy SUBJECT: Foskett General Plan Amendment SPECIFIC REQUEST(S) OR RECOMMENDATIONS(S) & BACKGROUND AND JUSTIFICATION RECOMMENDATIONS 1 . Authorize a General Plan review as requested by Walter Foskett for an approximately fifty-seven acre area located on the south side of Livorna Road in the Alamo -area. 2. Due to work priorities in the Community Development Department, staff should not initiate work on the amendment request until staff time becomes freed-up from work on the Countywide General Plan Amendment program. 3. That the amendment area to be considered would be as shown on the attached map. 4. That granting authorization of this request does not imply any support for the application, but only that this item is appropriate for study. 5. By authorizing this review, staff will proceed by preparing a report which would be scheduled for Public Hearing before the San Ramon Valley Regional Planning Commission. Following this, the Commission will forward its recommendations to the Board for public hearing and final determination. FISCAL IMPACT The applicant shall pay an amendment fee to cover the County's costs of this study. The fees will not be paid until the study is ready to proceed and shall be based on the plan amendment fees applicable at that time. CONTINUED ON ATTACHMENT: x YES SIGNATURE• BACKGROUND/REASONS FOR RECOMMENDATIONS A similar request was previously considered by the Board of Supervisors on January 5, January 12, February 12 and March 1, 1988. The Board of Supervisors on March 1, 1988 denied the Foskett study request but at the same time requested a status report from the Community Development Department after July 1988, following completion of the General Plan update. The original request as requested by Mr. Foskett, Mr. Raymond Suppe and Ms. Doris Anderson was for a plan amendment for their properties south of Livornia Road. To make a better planning boundary, staff included land, bringing the area up to 16 acres in size. Since that study request denial, numerous other plan amendment requests have been received by staff in that area. The attached map shows the original recommended area, additional plan amendment requests, and a reasonable plan amendment request boundary for study. Much of the discussion at previous Board meetings was on the merits of the plan change, rather than whether a study should be undertaken on this request. The current General Plan "fes designates the area as County Estates for which the proper minimum zoning is R-40 (40,000 sq. ft: lots) . Prior to the adoption of the San Ramon Valley Area General Plan, the area was shown as Single Family Residential - Low Density, 1-3 units per net acre, (minimum 15,000 sq. ft. lots) . These requests are to change the plan back to the original plan designation. Staff continues to feel that given the circumstances, such a study is a reasonable request; it has absolutely no position on the merits of a change at this time. A difficulty with authorization on such a contentious matter is that staff time is focused on the Countywide General Plan effort. Diversion from that mission onto this request would not be desirable at this time. After completion of major staff involvement on the plan revision effort, we would be in a better position to deal with this local issue. Authori- zation to proceed on this matter could be deterred until after that Countywide effort; that would appear to be appropriate. Staff has discussed this item with the Jobs/Housing Sub- committee of the General Plan Congress. They felt that this is a localized issue which won't affect Countywide planning issues and needs to be resolved as a local matter. ACTION OF BOARD ON August 9, 1988 APPROVED AS RECOMMM— ED X OTHER X Walter Foskett, 100 Vernal Drive, Alamo, appeared before the Board on this matter and presented a brief history of the request and spoke on issues including the size of the project, the timing involved, horses and recommendation no. 2 of the August 1, 1988 recommendations by staff, and requested that staff be directed to give the study top priority and also that staff be directed to put a stop to the zoning violations being committed by the horse breeders on Jennifer Lane. Jim Ornellas, 41 Vernal Court, Alamo, spoke against the Foskett plan and requested a continuation so that people that do oppose this request could be present. Ray Johnson, San Pablo, spoke in support of the issue. Steve Roberti, Central Labor Council and Building Trades Council, advised the Board that he has received a letter from Mr. Foskett saying if the study goes through and they're able to subdivide the lots, they will use union help or union workers on the project. Mr. Roberti urged the study. Supervisor Schroder moved approval of recommendations one through five and on recommendation no. 2 changing the wording to state that when staff is available for the project and remove reference to the Countywide Plan Amendment Program. Supervisor McPeak commented that she wanted everyone to be aware that the Board had held to its commitment of completing the General Plan Study and the work of the Congress before initiating this study in order to have in place major guidelines and that it is appropriate to move forward at this time. Therefore, IT IS BY THE BOARD ORDERED that recommendations 1, 2 as amended, 3, 4, and 5 are APPROVED.
