SUBJECT: Approving Plans and Specifications for the Subdivision
5066 Deficiency Correction Project, Project No. 4580-
6X5555-88, in the El Sobrante Area.
Specific Request(s) or Recommendations) & Background &
Justification
I. RECOMMENDED ACTION:
APPROVE the Plans and Specifications for the Subdivision 5066
Deficiency Correction Project and ADVERTISE for bids to be
received on Thursday, September 22, 1988, at 2:00 p.m.
DIRECT the Clerk of the Board to publish the Notice to
Contractors in accordance with Section 20392 of the Public
Contract Code,
DETERMINE that the project is categorically exempt from the
requirements of the California Environmental Quality Act (CEQA) ,
and
DIRECT the Director of Community Development to file a Notice of
Exemption with the County Clerk.
II. FINANCIAL IMPACT:
The estimated contract cost of the project is $12, 000.

II. FINANCIAL IMPACT:
The Public Works Director recommends that the project be funded
initially using general fund monies.
County Counsel has initiated legal action against the developer
and the bonding company to recover all of the County's costs
associated with the project. After the construction is completed
and all of the costs are known, County Counsel can conclude
litigation and the general fund will be reimbursed using the
funds collected from the developer and the bonding company.
III. REASONS FOR RECOMMENDATION/BACKGROUND:
On September 5, 1978, the Board approved a subdivision agreement
with Patrick and Linda Ellwood for construction of improvements
within Subdivision 5066.
On August 12, 1986, the Public Works Director reported that the
developers had failed to satisfactorily complete the subdivision
improvements and the Board of Supervisors authorized the Public
Works Director to arrange for their completion.
The Public Works Director has filed with the Board of Supervisors
the Plans and Specifications for the Subdivision 5.066 Deficiency
Correction Project.
The general prevailing rates of wages, which shall be the minimum
rates paid on this project, have been filed with the Clerk of the
Board and copies will be made available to any interested party
upon request.
The project has been determined to be in compliance with the
General Plan. This project is exempt from CEQA requirements as
a Class 1C categorical exemption because all of the work will be
performed on existing roadway and drainage improvements.
IV. CONSEQUENCES OF NEGATIVE ACTION
A portion of the drainage system within Subdivision 5066 carries
water that originates on County maintained roadways outside of
the Subdivision's boundaries. If the deficiencies are not
corrected, the Subdivision 5066 improvements, (which are located
within easements that have been offered to the County) cannot be
accepted for maintenance.
