SUBJECT: Results of Election for Sheriff-Marshal
Consolidation
SPECIFIC REQUEST(S) OR RECOMMENDATIONS) & BACKGROUND AND JUSTIFICATION
RECOMMENDATIONS:
1 . Receive from Robert J. Delevati, Assistant County Registrar,
the results of the election conducted August 25, 1988 among
all of the Judges of the Superior Court and Municipal Court,
showing that the Judges voted 23 for the consolidation to
occur in the Sheriff ' s Office, 2 for the consolidation to
occur in the Marshal' s Office, and that three Judges
abstained.
2 . In accordance with the vote of the Judges of the Superior
and Municipal Courts, and pursuant to AB 3014 (Chapter 444,
Statutes of 1988 ) , order the Sheriff-Coroner to take all
steps necessary to consolidate the court-related services of
his Office and that of the Marshal within the Office of the
Sheriff-Coroner pursuant to the provisions of AB 3014.
BACKGROUND:
On August 22, 1988, the Governor signed AB 3014 into law as
Chapter 444, Statutes of 1988. On August 23 , 1988, the Board of
Supervisors conducted the hearing required by AB 3014 . Based on
the testimony presented at that hearing, the Board of Supervisors
adopted a finding that there would be financial savings from
consolidating the court-related services of the Sheriff-Coroner
and Marshal.
On August 25, 1988, pursuant to AB 3014, the Assistant County
Registrar conducted an election among all of the Judges of the
Superior Court and Municipal Court. All 28 Judges participated
in the election. On August 29, 1988, the Assistant County
Registrar certified the canvass of that election indicating that
23 Judges voted to consolidate the court-related services of the
Sheriff-Coroner. and Marshal within the Sheriff-Coroner' s Office,
2 Judges voted to consolidate the court-related services of the
Sheriff-Coroner and Marshal under the Marshal, and 3 Judges
abstained from voting.
Pursuant to AB 3014, once the results of the election are
certified to the Board of Supervisors, the Board of Supervisors

is required to "immediately commence and, within a reasonable
time not to exceed 90 days, implement the determination made by a
majority of the Judges of the Superior and Municipal Courts. . . "
In response to the results of the election, therefore, the Board
of Supervisors is now required to implement the vote of the
Judges. We have, therefore, recommended that the Board of
Supervisors direct the Sheriff-Coroner to take all steps that are
necessary to consolidate the court-related services of the
Sheriff-Coroner and the Marshal within the Sheriff ' s Office.
