SUBJECT: Implementation of SB 1148, ) RESOLUTION NO. 88/ 565 Establish County Automated ) Fingerprint Identification Fund) The Contra Costa County Board of Supervisors RESOLVES that the Recommended Action herein is taken: I. Recommended Action. Adopts a resolution implementing Section 76009 of the Government Code establishing a County Automated Fingerprint Identification Fund in Contra Costa County. II. Financial Impact. The County Automated Fingerprint Identification Fund will receive an estimated $300,000 per year. III. Background. A. On September 27, 1987, the Governor signed SB 1148 (Ch. 1239, Stats. 1987), which added Section 76009 to the Government Code which allows the Board of Supervisors to establish by resolution a County Automated Fingerprint Identification Fund. B. The revenues for the Fund are from a $.50 (fifty cent) assessment for each $10.00 fine, penalty, or forfeiture imposed and collected by the courts for all criminal offenses and certain violations of the Vehicle Code. C. The Contra Costa County Remote Access Network (RAN) Board strongly supports the implementation of Government Code § 76009. D. The Contra Costa County RAN Board recommends that the Fund be used for the enhancement, replacement, and depreciation of the Contra Costa System and the shared main operating systems located in Alameda County. IV. Consequences of Negative Action. Without the Fund, enhancements to increase the level of service to User Agencies would be delayed or not implemented. V. General Discussion. If Contra Costa County becomes an Optional Trial Court Funding County, the revenue for the County Automated Fingerprint Identification Fund may no longer be available. Current interpretation of the Trial Court Funding Statutes (Ch. 1211, Stats. 1987) does not allow an Option County to collect this revenue. Numerous organizations and individuals are pursuing legislative and other options to exempt the Automated Fingerprint Fund from the provisions of Chapter 1211. 1 hereby certify that this 19-a true and correct copy of an action taken and entered on the minutes of the Board of Supervisors on the date shown. APPROVE and ADOPT Resolution establishing the County Automated Fingerprint Identification Fund and DIRECT the County Auditor-Controller to establish the Fund. 2.. DIRECT the County .Administrator, in cooperation with the Contra Costa County. CAL-ID RAN Board and the Alameda-Contra Costa County CAL-ID' Regional. RAN Board, to .develop a plan for the utilization of these funds that maximizes the effectiveness of. the CAL-ID Program. FINANCIAL IMPACT: The County Automated Fingerprint Identification Fund is authorized by Chapter 1239, Statutes of 1987, and permits a . $.50 (fifty cent). assessment to be imposed on certain: fines and forfeitures. It is estimated .that Ahis assessment will yield in Contra Costa County, on an annualized basis, approximately $300,000. The law provides that the funds ' collected, together with any interest earned thereon,. shall be held by the. County Treasurer separate from any funds subject to transfer or .division pursuant to Section 1463 ' .of the Penal Code. REASONS FOR RECOMMENDATIONS/BACKGROUND: Based on prior: Board. action., your Board authorized the 'initiation of a joint program with Alameda County providing- for. an automated fingerprint . information ,system, called CAL-ID. Funds' are provided .in the County budget -for the startup and operation of this program. In both Alameda, and Contra Costa .County startup has been- substantially completed and initial operations - will begin within a few .weeks.. It is .anticipated that this .program will significantly enhance the ability of law .enforcement officers to apprehend criminals based upon'the solid, physical' evidence .provided . by fingerprints. Adoption of this Resolution; will provide additional funds to.. increase the effectiveness of this system' and to .assist in the lease or purchase of necessary equipment.
