HomeMy WebLinkAboutMINUTES - 08021988 - 2.4 ORDINANCE NO. 88-65 (East County Regional Planning Commission) THE CONTRA COSTA COUNTY BOARD OF SUPERVISORS ORDAINS as follows (omitting the parenthetical footnotes from the official text as enacted or amended provisions of the County Ordinance Code) : SECTION I Section 26-2 . 1512 is added to the Contra Costa County Ordinance Code, to read: . 26-2 . 1512 East county regional commission. The East County Regional Planning Commission is established and shall have nine members . The Commission's territorial area of jurisdiction is all of the unincorporated territory located in the area bounded on the north, east and south by the Contra Costa County line and on the . west by a line beginning at the most northwesterly point of the Delta Diablo Sanitary District and following the westerly border of that District and the extension of that boundary line to the south to its intersection with the Concord City Limit line, following a northeasterly and then a southeasterly direction along the easternmost Concord City Limit and Sphere of Influence line to its intersection with the Clayton Sphere of Influence line, following that line to its northeasternmost point, and from that point to the southwest corner of the Black Diamond Regional Reserve, following the southern border of that Reserve to its most southeastern corner, and from that point due south to its intersection with the easternmost boundary of the San Ramon Valley Area General Plan and following that boundary in a southeasterly direction to its intersection with the Contra Costa and Alameda County line. The "East County Regional Planning Commission Boundary Description Map" , which is on file with the clerk of this board, is hereby adopted by this reference and available for public inspection in the community development department. Section 26-2. 1512 of the Code as adopted by this Ordinance shall be repealed and of no further force and effect beginning on October 28, 1988 unless this Board otherwise provides before then. SECTION III . Urgency Declaration. This Ordinance is an urgency measure to protect the public safety, health and welfare pursuant to the authorization of Government Code Section 25123 and Elections Code Sec. 3751, providing for the restoration and continued existence of the East County Regional Planning Commission. Pursuant to Section IV of Ordinance No. 86-47, the authority for said Commission has been repealed. The facts constituting the urgency are that if these urgency provisions are not adopted, decisions on pending applications before the Commission can not be made and some applications may be deemed approved which would frustrate Planning Agency land use regulation and public hearing procedures . SECTION IV. Effective Date. This Ordinance becomes effective immediately upon passage and within 15 days after passage shall be published once with the names of supervisors voting for and against it in the Antioch Daily Ledger , a newspaper published in this County. 88-65 PASSED on August 2, 1988 by the following vote: AYES: Supervisors Powers, Fanden, McPeak, Torlakson and Schroder NOES: None ABSENT: None ABSTAIN: None ATTEST: PHIL BATCHELOR, Clerk of the Board of Supervisors and County Administrator By.
