Encourage that report to suggest actions and programs the county can undertake to respond to this issue. FISCAL IMPACT: Staff time to respond to these issues. BACKGROUND: The newspapers have been reporting on this issue in depth lately. Item 3 . 2. on today' s agenda discusses the impact of ` the greenhouse effect on the East County area and raises several questions on the appropriateness of development in this area. We need staff to present a concept report on this issue to us. The Community Development Department should take the lead in pulling this report together. WHEREAS, . a request to amend the County General Plan at the western end of Evora Road in the Concord/Clyde area was received from Dean Lesher to redesignate a 63 acre area from General Open Space to Light Industrial; and WHEREAS, the Board of Supervisors authorized a general plan study of the site and three adjoining parcels owned by Streuli, Duarte and the Concord Sportsmen Club encompassing 15 acres. Alto- -gether, the study area encompassed 78 acres; and WHEREAS, it was determined that an Environmental Impact Report was required on the proposed plan amendment and such document was prepared and circulated according to State law, State guidelines and County guidelines for implementation of the California Environ- mental Quality Act; and WHEREAS, following publication of the Draft EIR on the general plan amendment proposal, a request by Dean Lesher (Applicant/Owner) ( 2773-RZ) was submitted requesting approval to rezone 63 acres of the 78 acre study area from General Open Space (A-2) to Controlled Manufacturing (C-M) was received on November 23,1987; and WHEREAS, it was determined that the Draft EIR prepared for the Lesher General Plan Amendment adequately addressed the potential environmental impacts associated with the rezoning application and could be used accordingly; and WHEREAS, after notice thereof having been lawfully given, a public hearing on February 23 and March 11, 1988 was had by the County .Planning Commission. After hearing all that wished to testify, the public hearing on the Draft EIR was CLOSED, while allowing receipt of written comments through April 1, 1988 ; and WHEREAS, on May 24, 1988, the Commission determined that the Draft EIR together with the Responses to Comments to be . adequate; and WHEREAS, staff prepared a report recommending changes in the requested amendment and rezoning and circulated, it to interested agencies, organizations and individuals; and Page 1 Re..olution No. 33-1988 WHEREAS, a public hearing was held on the Plan Amendment and rezoning application on Tuesday, May 24, 1988 and all who wished to speak were. heard by the Commission; and WHEREAS, ' the County Planning Commission CLOSED the public hearing and having fully considered and evaluated the testimony and evidence submitted in this matter; and WHEREAS, the applicant agreed to, and the Planning Commission imposed, a requirement that 20 acres W78 acre study area site; be designated as permanent open space and deeded to either the County or a Land Preservation Trust; and NOW, THEREFORE, BE IT RESOLVED that the County Planning Commission finds the Draft EIR, the Responses to .Comments and this statement of Findings and Mitigation Measures constitutes the Final Environmental Impact Report for both the General- Plan Amendment and Rezoning application; and BE IT FURTHER RESOLVED that the County Planning Commission having reviewed the Final Environmental Impact Report. and consider- ed the oral and ,written testimony submitted in response to ' it 'and reviewed the written ..replies to the comments and criticism, finds the environmental documents constituting the Final Environmental Impact Report to be adequate and that it has been completed; in compliance with the California Environmental Quality Act; with State Guidelines; and with County processing procedures; and BE IT FURTHER RESOLVED- that the following environmental findings of the -Final Environmental Impact Report apply: . LAND USE AND ZONING Impacts. The General Plan amendment and proposed developments would result in more intensified: uses of the area, in comparison to its current use for grazing and open space. Secondary impacts would be increased traffic, increased noise from traffic and as delivery vehicles, alteration of the existing visual setting and encouragement of additional growth in the area due to extension of water and sewer lines. to the site. Without a General Plan amendment (GPA) , the. proposed project would conflict with many policies of the current General Plan designation as Major Open Space. The proposed project ,would not be allowed under current zoning. : The project would . require changes to existing spheres of influence and district boundaries in order to be included within the spheres of influence and the service districts . of the Central Contra Costa Page 2 Re..olution No. 33719;88 Sanitary District . and the Contra Costa Water .District. Changes, to these boundaries could _increase development pressure for other un- developed lands which. would be crossed by new-sewer and water lines. Mitigation Measures Development should be- clustered near- the western edge of the parcel where less cut and fill would be required, resulting in less alter- ation . to the natural environment. Part of the site could be deed restricted to the County -as open space. Mitigation measures suggested in other parts of. the EIR should be incorporated into the project when appropriate and included as part of the General Plan .amendment. A minimum 20 acre -portion of the 62 acre Lesher parcel within the 78-acre General Plan Amendment Study. Area shall be designated': as permanent .open space and deeded to either the '. County or a Land Preservation Trust; and A GPA could be granted for only that portion of the site nearest the interchange of Highway #4- and Willow Pass Road in order' to protect surrounding open space lands from future conversions :and GPA' s. Buffer zones should be designated near recreational trails. See Public Services Section of Chapter 3 of the EIR. GEOLOGY AND SOILS Impacts . .Potential seismically-induced geologic hazards include liquefication, landslides', lurching, or settling; of fill areas. Structures may be subject to intense groundshakingduring an earth- quake. The project may be affected by landslides, expansive soils, soil creek and instability of - graded areas. Construction activities would increase the . potential for soil eros- ion by wind and rain. Mitigation Measures Proposed structures should. be designed to include factors for with- standing stresses resulting from liquefaction, lurching and differ- ential settlement. Fill should be thoroughly compacted. Fill slopes may require buttressing and retaining walls should be in- stalled north of the development area. . Page 3 Re6olution No. 33-1988 Foundations should be placed on bedrock whenever possible and proper- engineering procedures should be undertaken to reduce poten- tial damage and personal injury. Grading should be carried out to maximize slope stability. Build- ing foundations should be designed and constructed with potential soil expansion and soil creep in mind. Buildings could be clustered in more level portions of the site to reduce the potential for slope instabilities. Construction should be during dry summer months. Graded areas should be revegetated immediately after completion of construction. HYDROLOGY AND WATER QUALITY Impacts Increased runoff would result from the proposed project which could affect the water quality of the Contra Costa Canal or increase the 'probability of downstream flooding if diverted to Mt. Diablo Creek. Surface . and groundwater deterioration could result from oils and heavy metals washed from parking areas, and from wind and water- borne sediments carried off-site during and after construction. Drainage and groundwater recharge may be affected by the filling of an intermittent streambed which contains a spring. Mitigation Measures A collection system for runoff should be designed into the proposed project. The capacity of Mt. Diablo Creek should be determined be- fore any runoff is diverted to this creek. A collection system to divert runoff around Contra Costa Canal could reduce contamination of this waterway. Water quality test- ing could determine appropriate handling of runoff. Construction during summer months, covering of exposed soils and installation of sedimentation basins could reduce water pollution. Drainage culverts could be emplaced under and around fill areas to channel runoff. This runoff could be allowed to percolate into the ground to minimize loss of groundwater recharge. Further investi- gation of the spring should be ,completed. BIOTIC RESOURCES Impacts: The change in general plan designation would eventually result in elimination of all existing grassland on the site. - No rare or en- dangered species would be affected. Page 4 Resolution No. 33-1988 Sediment, grease and oils could be carried offsite and could affect aquatic habitats of Mt. Diablo Creek and Suisun Bay., Mitigation Measures A minimal amount of habitat could be restored by landscaping the developed area with native species. Refer to mitigation measure in Hydrology section of Chapter 3 of the EIR. PUBLIC SERVICES AND UTILITIES Impacts Approval of annexation and a change to the sphere of influence boundaries by the Local Agency Formation Commission and the Central Contra Costa Sanitary District would be required before sewer service could be provided to the project area. New sewer lines would have to be constructed. Approval of annexation and a change to the sphere of influence boundaries by the Local Agency Formation Commission and the Contra Costa Water District would be required. Extension of water lines would be required. Approximately 104,470 gallons of water per day could be required by total buildout of the project area. The proposed project would result in an increased need for fire protection services. Response time to the project site (9-12 min- utes) would mean a substandard level of emergency service until a new fire station is constructed. The need for police protection services would increase at the pro- ject area due to an increase in population. The Contra Costa Sheriff 's Department does not anticipate a need to expand staff or to purchase new equipment to serve the project area. The proposed project would not have a direct impact 'on school en- rollment due to being an industrial development. Increased traffic caused by the project would not affect the safety of school child- ren due to the project' s distant location from schools. The proposed project is not expected to increase the need for park and recreational facilities. The proposed EBRPD trail along the Contra Costa Canal could be impacted by project development. In the short term, no problems are anticipated in meeting the solid waste removal needs of the proposed project. Hazardous wastes would be generated on the site. Although gas lines would have to be extended to the site which may require obtaining right-of-ways, no problems are anticipated in Page 5 Resolution No. 33-19 r _ gg meeting the natural gas and electrical requirements of the- proposed. project. Mitigation Measures To minimize growth-inducing impacts, any new sewer line should be sized to only serve the project area .and should be routed away from the undeveloped : parcel to the north of the project area. Adequate right-of-way . should -be taken. to avoid valuable.hhabitat during construction of new sewer lines. , Revegetation should occur inall disturbed areas. To avoid growth-inducingimpacts, new water . Iines` and tank should be sized to only serve the project area and ' should follow . the recommended alignmentof new sewer lines to minimize construction impacts. Right-of-way access should be. acquired, for any water line extensions. Water conservation measures should be incorporated into the project design if annexation occurs. Evaluation: of the project by the Contra Costa Water District to determine any problems with meeting additional water supply needs would be required. 8 s care, oot of. co str on' ro ort' on- A pro .rata fee of $0. 1 / q f n ucti top p i ately offset initial .expenditures for additional fire control would also be required. Fire protection measures for grassland surround- ing the development °within the project area could include weed abatement and the use of fire-retardant landscaping and roofs in the proposed design. The portion of the project area not proposed for. development should be deed restricted or sold as permanent open - space to protect ', the hillsides and to • reduce pressure . for development', of surrounding lands.' Setbacks and .landscaping should be incorporated into .' the project. design .to. minimize impacts to the proposed `trail. Recycling programs should be established.- All hazardous: wastes should be established. All hazardous wastes should be stored . and removed according to current county, state and federal regulations. Energy conservation measures recommended - in the Energy Section of Chapter 3 in -the EIR should be incorporated into the proposed pro- ject. A site plan should be submitted .to PG&E for 'review to deter- mine the best routes' for new gas lines. Traffic and Circulation Impact i Much of the traffic associated with the newspaper printing industry would occur between 4: 30 AM and 7:00 AM, before the morning peak traffic hour. The. project would generate 350 to 40'0 Page .6 Resolution No. 33-1988 daily . trips, 24 AM peak-hour trips, and 30 PM peak-hour trips. Additional development on 54 acres would result in 3,510 daily trips, with 421 during the AM peak hour and, 386 during the PM peak hour. Without the project, cumulative projects are expected to double .the AM peak hour traffic on Evora Road at the Willow Pass interchange with Highway #4. The intersection of Evora Road and Willow Pass Road would be heavily 'congested with cumulative traffic. The level of service at Evora and Willow Pass Roads would dropto "D" with cumulative traffic (with the widening of Highway #4) . Without improvements to Highway #4, full buildout �of the project area would result in significant traffic impacts at ;the Evora Road/ Willow Pass Road/Highway #4 intersection area. ' Project access from a driveway that extends no'rth!" at the Willow Pass/Evora Road intersection could have significant 'Impacts on this intersection. The second access road proposed could handle all project-related traffic. Full site development may warrant new bus service ' to the project area that is currently not available. More than enough parking is expected to be provided.] Extensive 'cut and fill would be required for constructing- surf ace parking areals. The project is not expected to directly impact the'! development or use of trails proposed along the Contra Costa Canal. If Port Chicago Highway is closed and. Evora .Road is extended, traffic would increase along Evora Road and Highway ''44. Mitigation Measures " Project developers should be responsible for necessary intersection improvements. Ride-sharing incentives for workers should be offered. . A commute period transit service 'to, the, .area after full site buildout should be considered. Evora Road should be widened and restriped to accommodate new turn- ing lanes. Signal control at the Willow Pass Road on and off-ramps and the Evora Road/Willow Pass Road intersection should be considered if Highway #4 is not . widened as p-lanned.';. Two lane left-turn movements. from Evora Road and s1ignalizationi at all three intersections in the vicinity would be necessary to con- trol traffic movements. Full buildout of the project. area could be restricted until Highway #4 improvements are completed. Page• 7 Resolution No. 33-1988 The County Public Works Department should review the proposed access roads. This one access road may need to be eliminated. When full site buildouthas occurred and service extensions would be cost effective; local districts should be encouraged to extend service to the site vicinity. Development should be clustered in level portions,, of the site. to reduce cut and fill requirements for parking areas: Parking could also be provided.. in a series of .terraces to reduce cut and filli Landscaping should be provided along these trails and near proposed development to encourage. use of the proposed trails after they' are constructed. Full. buildout of the. project area should be . considered in '; the planning and analysis of ,.the Port Chicago Highway closure. NOISE s Impacts The main increase in noise from the proposed newspaper printing industry would be from the loading dock area and ventilation ducts. Construction noise would be temporarily experienced by CNWS. residents. Mitigation Measures The noise sources should be located away from the CNWS barracks, As has been proposed by the applicant. Windows and door openings should be avoided on the west side .of the building if 'the pressroom is to be located on this side. A number of noise-reducing measures for construction activity should be enforced. These are addressed in the Noise section of Chapter 3 of the EIR. AIR QUALITY Impacts: Site preparation .activities would result in emissions of a number of pollutants. The major contaminant would be ' particulate matter (TSP) in 'the form of fugitive dust. State and federal air quality standards would not be violated except for TSP which would be tem- porary. Vehicular emissions would increase with increased ,;traffic. Carbon monoxide levels would not exceed the California standard for either 1-hour or 8-hour concentrations Page 8 h_jo'luton No. 33-1988 t. Contaminants would be released into. the atmosphere by the operation of the newspaper printing industry. Other industries that locate. at the project area may also contribute contaminants. f Mitigation Measures Fugitive dust emissions should be limited by clustering development in more level portions of the project area, applying water or dust suppressants to. working surfaces, and'.limiting construction equip- ment to dust controlled routes. Vehicular emissions could be reduced with measures that reduce traffic delays :and associated idling time. Emissions would also be reduced by reductions in private automobile use.- Industrial facilities would be required. to comply with ; all applicable rules of the Bay Area 'Air Quality Management District. A permit would be required for - the proposed newspaper printing industry. Other future development should comply with BAAQMD rules and regulations., VISUAL QUALITY , l Impacts: Existing topography, as seen from Highway #4 and other locations, would be significantly altered due to extensivecut and fill. Further industrial development would require additional cut and fill. New buildings related to- printing operations would',' be located on a visually prominent knoll in the center of the project area. Other structures would be constructed on an additional l54 acres of' the project area. If bicycling; riding and hiking trails proposed along the Contra Costa Canal are constructed in the future, new development would be highly visible from. this location. It is anticipate& that surface parking areas would' be lit at night due to nighttime operations of the printing operations. Glare could be created which would impact adjacent residentsii of the Concord Naval Weapons Station. MITIGATION MEASURES Alteration of the natural topography should -be minimized by clustering development in the more level portions of the project area. Revegetation of any cut and fill areas should take palace immediately after grading has been completed to ; minimize visual impacts. r Page 9 i I R.. molution No. 33-1988 Structures should be clustered in less visible and more level portions of the site. Landscaping should ;be required around gall new buildings and parking areas t Landscaping should be incorporated .into the project to screen' it from the view of those using these trails if they are developed. All outdoor parking areas should have direct lighting which` is beamed downward and shielded to avoid nighttime glare for resi- ' dents of CNWS. To reduce potential glare, buildings should, be clustered in more level portions of the project area. Landscap? ing should also be incorporated to minimize potential impacts from glare. A lighting plan should be submitted for 'review. before con- struction is permitted to ensure that adjacent residences would:,not be impacted PUBLIC HEALTH -AND SAFETY. Impacts i The proposed project is, not expected to impact or, be impacted by the Los Medanos Gas Fields located adjacent to the project area. A grass fire started by a leak or failure at the gas "fields coulden- danger project occupants, , especially with the limited emergency, re- sponse time available from the nearest fire station;. The proposed . printing operations would generate hazardous wastes such as waste inks and solvents. Spilled ink could` contaminate� the Contra Costa Canal.. Other industries locating in the project area might require hazardous materials. Mitigation Measures All construction plans should be carefully reviewed by PG&E to ensure that disturbance to a main gas line isu: avoided. Fire protection"measures should be enforced and project employees should establish good communication with employees of- the gas fields in case of an emergency. Lesher communications should submit plans to the Contra Costa San- itary District for review prior to . All federal, state and county rules and regulations for handling and disposal of wastes should be complied with., To protect the Contra Costa Canal, the parking lot should be designed to act as a retention basin; for Any spilled ink. ENERGY Impacts Energy use at the project area would increase with,'the introduction lighting, heating and transportation. Mitigation Measure: Page 10 i Resolution No. 33-19`88 A variety of building design and transportation measures should, be implemented. These are discussed in, greater detail in the Energy Section of Chapter 3 of the EIR. CULTURAL RESOURCES: Impact: No prehistoric or historic cultural resources are expected to, be encountered at the project area. Mitigation Measure: If any archaeological materials are found during construction, an archaeologist should evaluate the situation. Construction teams should avoid altering the material. SOCIO ECONOMICS: Impacts: Approximately 70 persons would be employed at the newspaper print- ing facility, which would be ten miles northeast of the existing facility. The additional industrial development that could "occur at the project area could. result in 495 to 1,245°' new employees. There is no .public transportation into the project area so print- ing and any other employees would have to commute by private auto- increasing traffic congestion and auto-related emissions. Approximately five to eight new employees are expected to be hired at the existing Walnut Creek facility. They might have to commute from areas outside of Walnut Creek in order to find affordable housing Mitigation Measures: The County could require that the development occur Jn closer prox- imity to' existing residential areas. The County Could establish a program linking project-generated new housing demand to provision of housing by developer or contribution to the County of in-lieu fees. BE IT FURTHER RESOLVED that the County Planning Commission recommends to the Board of Supervisors APPROVAL of ,an amendment to the Land Use Element of the County General Plan as indicated on :the maps and revised plan text attached hereto and made a part hereof as Exhibit A; and BE IT FURTHER RESOLVED that specific economic, social or other considerations make infeasible the mitigation measures or plan alternatives of some of the items identified in the Lesher General Plan Amendment EIR. RESOLUTION NO. 88/534 SUBJECT: In the matter of the Lesher ) General Plan Amendment. ) The Board of Supervisors of Contra Costa County RESOLVE: That there is filed with this Board and its Clerk, a copy of Resolution No. 33-1988, adopted by the County Planning Commission proposing an amendment to the County General Plan in the Concord/ Clyde area along Evora Road and proposing an amendment to the zon- ing for a portion of the Lesher parcel from General Agriculture (A-2) to Light Industrial (L-I ) . The Commission approval for the amendment calls for a change from General Open Space to Light In- dustry. On August 16, 1988, the Board held a hearing on said amendment. Notice of said hearing was duly given in a manner as required by law. The Board, at the hearing, called for testimony of all persons interested in this matter. The only person to testify on this matter was Norman L. Halverson of Bryan & Murphy Associates, representing Dean Lesher, speaking in favor of the amendment text and map. Mr. Halverson requested modification of the plan text to substitute the requirement for the processing of a development plan -to be administratively reviewed by the Zoning Administrator in lieu of the requirement for processing of a land use permit. The Board asked staff about the acceptability of the proposed change. Staff responded by indicating that the proposed modifica- tion was acceptable. At the conclusion of the testimony, the Board closed the public hearing. Supervisor McPeak moved to approve the Lesher General Plan Amendment, rezoning File #2773-RZ in general accordance with the County Planning Commission recommendation and to accept the envir- onmental documentation. The motion further directed that the Development Guidelines Section of the Plan text be modified to read as follows: "IV. DEVELOPMENT GUIDELINES A.
