SUBJECT: Delta Diablo Sanitation District Request for Landfill
Siting Outside District Boundary
The Board on August 9, 1988, continued to this day its dis-
cussion on the request ( letter dated August 5, 1988) of. Delta
Diablo Sanitation District for permission. to own a landfill site.
outside. the District.' s boundary. The Board. also received on this
day a report from County Counsel responding to questions of Board,
members relative to Delta. Diablo' s request..
Supervisor Schroder absented himself from participating in the .
discussion of this matter because of possible conflictof interest.
concerning a business relationship. Supervisor. Torlakson chaired.
this portion of the Board meeting.
The Board also received a letter dated August 12, 1.988, from
A. B. McNabney, Vice President-Conservation., Mt. Diablo Audubon.
Society, P. O. Box 53 , Walnut Creek 94596, expressing opposition to
granting Delta Diablo' s request for the reason that the Board has
approved placement. of the waste landfill sites on the November
ballot and that granting of the request might becloud the issue.
Supervisor Torlakson commented. on studies conducted by Delta
Diablo. which are available for public. review. He advised that
Waste Management. Inc. , who is believed. to have expressed an inter-
est in the Marsh Canyon site, has agreed to reimburse the Sanitary
District for copies of its studies if it decides. to acquire. the
site. He requested the Board to consider the District.' s generic .
(general) request for approval to investigate. landfill. sites in. the.
unincorporated areas of the County outside its boundaries.
Supervisors Powers and Fanden expressed concerns on various
issues: that there is. no confirmationas to who actually is the
applicant .for the Marsh Canyon landfill. site; that if the Board
were to grant permission to the Delta Diablo Sanitation District..
there might be. potential risk. to the integrity of the CEQA process;
that a large amount of money has been expended by a public agency
(Delta Diablo) for studies which may benefit a private company who
may acquire the Marsh Canyon site for a landfill; and. that since
the Board has approved placing this. matter before the electorate at.
the November. 8, 1988 election, taking this action may confuse the
issue before the voters. They expressed the belief that it would_
not be fair to other applicants who have followed the land use.
application process. if the Board granted the request. of. Delta .
Diablo. They therefore stated they would not vote in. support of.
the Sanitation District' s request.
Supervisors Torlakson and. McPeak spoke in support of the
request of Delta Diablo. They commented onthe process employed by
Delta Diablo in deciding on the suitability of the Marsh Canyon
site. They also expressed support for a public/pr.ivate. partnership.

Supervisor Torlakson moved that the Board. approve the request
of Delta Diablo for the Marsh Canyon site and request staff to
negotiate an agreement to insure the District' s strict compliance.

David Tam, representing the San Francisco Bay Chapter of the
