SUBJECT: Approval of "Texas Hold'em" Card Game in Contra_
Costa County
The Board on July 1.2., 1988, ref.erred. to the Sheriff-Coroner,
District Attorney, and. County Counsel the request of Wilbur
Duberstein, attorney for licensed card clubs., P. O. Box 574, San.
Ramon 94583 , that the County' s cardroom ordinance be amended to
permit Texas Hold'em as one of the additional. two card games .
allowed to be played in Contra Costa County.
The Board received a. report from Richard K. Rainey,
Sheriff-Coroner advising of the Attorney General.' s position towards
"Texas Hold'em. " The Sheriff advised that he has no objections to
the Board of .Supervisors allowing the "Texas Hold'em" card game to
be played in this County, either by amending County Ordinance Code.
Section 52-3 . 107 or leaving 52-3.107 as it stands, allowing only
the three card games now mentioned.
Board members agreed that the Ordinance should be reviewed for
possible amendment.
Therefore, IT IS BY THE. BOARD ORDERED that the Sheriff and.
County Counsel are REQUESTED to review the County Cardroom.
Ordinance for possible amendment and- report- to the Board on October.
18, 1988.
The Board then adopted Resolution No. 88/542 approving "Texas .
Hold'em" card game in Contra Costa. County.

SUBJECT: Approval of "Texas ) RESOLUTION NO. 88/ 542

Cardrooms in Contra )
Costa County. )
1. This Board having received a request from Attorney Wilber Duberstein
on behalf of cardrooms in this County that a game known as "Texas Hold'em" be
approved for play in such cardrooms; and
2. "Texas Hold'em" being a game described as follows:
"Each player antes a specified amount of money. Thereafter the cards are
dealt as follows:
First Round. Two playing cards .are dealt face down
to each player.
Second Round. Three playing cards are dealt face up
in the center of the table common to
all players.
Third Round. One playing card only is dealt face
up in the center of the table common
to all players.
Fourth Round. One playing card only is dealt face
up in the center of the table common
to all players.
The players bet after each round and after the fourth round of
betting, each active player will have seven cards (two personal
cards dealt face down and five community cards face up in the center
of the table). A player may use any combination of five cards
(using three, four, or five community cards) to determine h i s or her
best high hand. The active player holding the best high hand is
the winner. "
3. "Texas Hold'em" having been declared not to be in violation of Penal
Code § 330 by the Superior Court in and for Alameda County; and
4. Both the Sheriff and the District Attorney having stated that they
have no objection to the approval of "Texas Hold'em" as described in Paragraph
2. above, as a game which may lawfully be played in cardrooms licensed by the
County; and
5. County Ordinance Code § 52-3.107 allowing the Board to by resolution
add up to two games not named in to those permitted to be played in cardrooms
licensed by the County;
NOW THEREFORE, BE IT BY THE BOARD RESOLVED that pursuant to County
Ordinance Code § 52-3.107 the card game known as "Texas Hold'em" as described
in Paragraph 2, hereinabove, is permitted to be played in cardrooms licensed in
this County, provided however, if "Texas Hold'em" is declared to be in violation
of any statute of the State of California by any court of record in this State,
this Resolution shall be void.
